Book excerpt: Les jurisconsultes Maleketes définissent le bien immeuble comme comprenant : le terrain, les édifices sur le terrain et la contenance intrinsèque à savoir en premier lieu l'eau qui en constitue un élément essentiel. Le protectorat français a institué un système "bicéphale" à savoir qu'à côté des immeubles immatriculés se trouvent des immeubles non immatriculés soumis au rite Malikite et d'autres soumis à un statut spécial institué par le système "Makhzeniein" notamment les terrains de "Elguich" ou les terres collectives. Ainsi, le régime juridique de l'eau est demeuré soumis au rite Malikite- droit musulman- et aux coutumes locales contenues dans les doctrines de "Souss", Fès et de Marrakech. Ces dispositions ont notamment servi pour pallier aux lacunes du statut des immeubles immatriculés et pour lesquels il n'a pas été prévu de dispositions spécifiques. La jurisprudence s'est heurtée ainsi au problème du droit applicable : est-ce le rite Malikite ? les coutumes locales ? La réponse devrait être différente selon que l'on invoque tel ou tel statut légal. Au lieu d'intervenir pour départager la jurisprudence, le législateur est intervenu au sens inverse, à savoir la consécration du différent sans le résoudre en réservant un régime spécifique à l'eau découlant des immeubles immatriculés, mais pour les autres , il n'a pas résolu le désaccord. Concernant ce sujet, on peut relever plusieurs problématiques parmi lesquelles on peut citer : Quelles sont les points de convergence et divergence des différentes sources légales ? L'aspect tripartite des sources légales permet-il une meilleure exploitation de la masse des propriétés immobilières au Maroc ?
