Book excerpt: L'allégement de la dette extérieure est devenu la principale solution adoptée au cours des années quatre vingt dix pour faire face aux problèmes de remboursement des pays débiteurs. On explique dans cette thèse qu'il s'agit d'une solution dont l'adoption est liée aussi bien à l'évolution des faits que de la théorie, et on cherche à examiner empiriquement sa nécessité et son efficacité. Nos tests empiriques ont été basés sur un modèle de croissance néoclassique élargi pour tenir compte du capital humain et d'autres variables macro - économiques. L'échantillon est composé de 69 pays en développement étudiés sur la période 1986-1998. Les résultats économétriques ont montré que :L'allégement de la dette s'avère nécessaire pour les pays caractérisés par des difficultés structurelles de remboursement représentant un certain poids par rapport à leurs dettes. Ces pays sont considérés comme surendettés. L'efficacité de l'allégement de la dette ne s'est manifestée que dans les pays non surendettés. L'examen de quelques variables macroéconomiques dans ces deux groupes de pays a montré que les pays non surendettés ont été caractérisés par de meilleures politiques économiques. Notre conclusion a été de dire que, pour qu'il soit efficace, l'allégement de la dette doit être lié en premier lieu à la nature des politiques économiques adoptées.

Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Book excerpt: In 2009, the International Labour Organization (ILO) celebrated its ninetieth anniversary. The First World War and the revolutionary wave it provoked in Russia and elsewhere were powerful inspirations for the founding of the ILO. There was a growing understanding that social justice, in particular by improving labour conditions, was an essential precondition for universal peace. Since then, the ILO has seen successes and set-backs; it has been ridiculed and praised. Much has been written about the ILO; there are semi-official histories and some critical studies on the organization's history have recently been published. Yet, further source-based critical and comprehensive analyses of the organization's origins and development are still lacking. The present collection of eighteen essays is an attempt to change this unsatisfactory situation by complementing those histories that already exist, exploring new topics, and offering new perspectives. It is guided by the observation that the ILO's history is not primarily about «elaborating beautiful texts and collecting impressive instruments for ratification» but about effecting «real change and more happiness in peoples' lives».
