Book excerpt: Cet ouvrage pose comme problematique de savoir si l'application du principe de non-discrimination se limite aux travailleurs migrants ressortissants des Etats membres. En d'autres termes, il tente de repondre a l'interrogation suivante a savoir si l'applicabilite du principe que connaissent les travailleurs migrants peut etre transposee dans d'autres domaines de l'Union, autres qu'economique. Cette etude souligne les etapes importantes du processus de generalisation de l'application du principe de non-discrimination en raison de la nationalite decoulant du developpement legislatif et jurisprudentiel de l'Union europeenne. La premiere etape est de montrer le lien existant entre le travailleur migrant et le principe de non-discrimination. La seconde est l'evolution apportee a l'application du principe provenant de la multiplication de regimes de libre circulation des personnes. La derniere etape consiste a souligner l'impact du principe de non-discrimination dans d'autres spheres tel que la libre circulation des marchandises ou encore celle des droits fondamentaux. Cet ouvrage s'adresse essentiellement aux lecteurs s'interessant a l'Union europeenne et a ses principes fondamentaux.

The author brings to them not only his background of academic distinction, but his experience as a practitioner concerned with major international legal issues. The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Such seasonal movements have formed an important aspect of many European farming systems for several thousand years, although they have declined markedly since the nineteenth century. Ethnographers and geographers have long been involved in recording transhumant practices, and in the last two decades archaeologists have started to add a new material dimension to the subject. This volume brings together recent advances in the study of European transhumance during historical times, from Sweden to Spain, Romania to Ireland, and beyond that even Newfoundland. While the focus is on the archaeology of seasonal sites used by shepherds and cowherds, the contributions exhibit a high degree of interdisciplinarity. Documentary, cartographic, ethnographic and palaeoecological evidence all play a part in the examination of seasonal movement and settlement in medieval and post-medieval landscapes. Notwithstanding the obvious diversity across Europe in terms of livestock, distances travelled and socio-economic context, an extended introduction to the volume shows that cross-cutting themes are now emerging, including mobility, gendered herding, collective land-use, the agency of non-elite people and competition for grazing and markets. The book will appeal not only to archaeologists, but to historians, geographers, ethnographers, palaeoecologists and anyone interested in rural lifeways across Europe.
