Book excerpt: In this monumental book, sociologist Robert Castel reconstructs the history of what he calls "the social question," or the ways in which both labor and social welfare have been organized from the Middle Ages onward to contemporary industrial society. Throughout, the author identifies two constants bearing directly on the question of who is entitled to relief and who can be excluded: the degree of embeddedness in any given community and the ability to work. Along this dual axis the author locates virtually the entire history of social welfare in early-modern and contemporary Europe.This work is a systematic defense of the meaningfulness of the category of "the social," written in the tradition of Foucault, Durkheim, and Marx. Castel imaginatively builds on Durkheim's insight into the essentially social basis of work and welfare. Castel populates his sociological framework with vivid characterizations of the transient lives of the "disaffiliated": those colorful itinerants whose very existence proved such a threat to the social fabric of early-modern Europe. Book excerpt: This was first published in 2000: This work is founded on the premise that many analyses of economic restructuring and of gender relations fail to recognize two things. First, the situation facing women is different from that of the 1960s when the conceptual apparatuses for analyzing "women and work" were created. Labour markets are dominated by flexible, non-standard work, precarious contractual relations and income disparities. Therefore, it is difficult to structure political claims or analysis around the notion that there is a single labour market, that the primary problem is discrimination or inappropriate training, and that political strategies should focus on discrimination and non-traditional employment. Rather, new challenges require new solutions. The second point of departure is that is is impossible to understand either contemporary labour markets, or the roots of employment and other public policies without locating them vis a vis patterns of gender inequalities generated by and in these labour markets. The labour force has been feminized to such an extent that new, and often unequal gender relations are crucial to their very functioning.

It is in large part the changing role of women that explains the new household structure, our altered demographic behaviour, the growth of the service economy and, as a consequence, the new dilemmas that the advanced societies face. Most European countries have failed to adapt adequately to the novel challenges and the result is an increasingly serious disequilibrium. Women explicitly desire economic independence and the societal collective, too, needs to maximise female employment. And yet, this runs up against severe incompatibility problems that then result in very low birth rates. Our aging societies need more kids, yet fertility levels are often only half of what citizens define as their desired number of children. No matter what happens in the next decade, we are doomed to have exceedingly small cohorts that, in turn, must shoulder the massive burden of supporting a retired baby-boom generation. Hence it is tantamount that tomorrow’s adults be maximally productive and, yet, the typical EU member state invests very little in its children and families.

Book excerpt: This book focuses on the Hanafite school of fiqh which originated in the eight century and is, geographically, the most widespread and, numerically, the most important representative of Muslim normativeness. The fiqh consists of liturgical, ethical and legal norms derived from the Islamic revelation. The introduction outlines the main boundaries between fiqh and theology and follows the modern debate on the comparison between the fiqh and the secularized law of the modern Occident. The core of the book is dedicated to the way in which the fiqh, in the period between the 10th and the 12th centuries, adapted to changing circumstances of urban and agricultural life (chapters I and II), to the way in which it marked off legal from ethical norms (chapter III), religious from legal status (chapters IV to VI) and legal propositions from religious judgment (chapter VII). The forms in which change of norms was made acceptable is discussed in chapter VIII. The last chapter deals with an attempt of Shi'i scholars in the Islamic Republic of Iran to answer new problems in old forms.
