Ces mineurs interrogent diverses disciplines : justice, médecine, psychologie, sociologie. Toutes font le constat de la nécessité de leur porter une attention particulière. S'il n'y a pas de profil type à cette délinquance, la plupart des auteurs mineurs de délits sexuels a été victime de violence quelle qu'en soit la nature. Le parcours médico-judiciaire auquel le mineur délinquant est confronté débute par l'audition. Nombre de mesures ont été prises pour améliorer les conditions des auditions des mineurs victimes dans un but de prévention et de meilleure prise en charge ; parmi elles, la création de salles d'audition et le développement de techniques spécifiques d'entretien. Il semble que le mineur auteur ne bénéficie pas des mêmes conditions de recueil de sa parole. Or il existe deux enjeux autour de l'audition d'un mineur. Le premier est pénal : obtenir des informations valides pour qualifier correctement une infraction. Le second est sanitaire : initier, lorsque cela est nécessaire, une prise en charge médico-psycho-sociale. Offrir aux mineurs auteurs les mêmes conditions du recueil de sa parole peut paraître un traitement « bienveillant » gommant la nécessité d'une répression de ses actes. Nous partageons un autre point de vue. Mener l'audition d'un mineur délinquant sexuel dans des conditions adaptées présenterait pour avantages de mieux caractériser les faits, de donner au mineur l'occasion de révéler d'éventuels faits de violences et ainsi de ne pas méconnaitre une infraction. Une telle audition permettrait également de débuter une prise en charge médico-psycho-sociale adaptée, à l'instar de ce qui est proposé pour les mineurs victimes.
