Cet «intérêt supérieur» constitue une formule théorique qui désigne essentiellement l'intérêt des parents. Ces enfants de 0 à 6 ans, mais parfois plus âgés, sont très souvent traités comme des biens indivis qui relèveraient d'un droit de propriété. Ils sont donc partagés, condamnés à mener une double vie, sans repère fixe affectif ni géographique, avec toutes les conséquences qui s'ensuivent sur la construction de leur personnalité. Malgré les travaux des pays anglo-saxons qui nous ont précédé dans la voie de la résidence alternée et en constatent les méfaits chez nombre d'enfants, la loi définitive a durci sur certains points la proposition initiale. Le présent livre a pour objet de briser cette quiétude, d'informer, d'interpeller les consciences, de provoquer si possible une réaction politique pour modifier le texte de loi.
