En effet, le legislateur pose clairement le principe selon lequel les collectivites locales "s'administrent librement par des conseils elus" (prolongement de l'article 72, alinea 2 de la constitution francaise du 4 octobre 1958). La libre administration des autorites decentralisees est assortie d'un control "a posteriori" limite a la legalite. Ce qui se traduit par la possibilite pour le prefet de saisir le juge administratif pour en demander soit l'annulation, soit le sursis a execution d'une decision consideree, par lui, comme irreguliere en droit. Les recherches jurisprudencirelles entreprises ont permis de mettre en evidence les mecanismes de control (1ere partie). Dans la "phase non contentieuse" (chapitre 1) le prefet a un large pouvoir d'investigation. "la phase contentieuse" (chapitre 2) met en valeur deux techniques procedurales qui sont, d'une part, le desistement, et, d'autre part, le sursis a execution. L'etude a, de meme, tente d'analyser la mise en oeuvre des mecanismes de controle (2eme partie) dans le cadre d'une nouvelle organisation des institutions locales (chapitre 1) desormais elues, chargees de la gestion des responsabilites (chapitre 2). Plus de huit annee se sont ecoulees et conduisent a etablir une classification des contentieux de part leur importance quantitative et qualitative. Le libre administration a besoin encore de la duree pour s'ancrer, elle est de plus sujette a quelques modifications eventuelles a l'aube de l'europe de 1992.
