Book excerpt: Notre projet vise à mesurer l'impact de l'interdiction du harcèlement psychologique au travail sur les droits de direction de l'entreprise au Québec (art.81.18 et s., L.n.t ), comme dans ce domaine d'autres pays se sont illustrés en tant que pionniers par l'instauration d'un cadre législatif interdisant le harcèlement moral au travail et par souci d'avoir une vision plus globale du phénomène, nous avons trouvé utile d'aborder le sujet sous une approche de droit comparé, analysant simultanément les droits français, belge et québécois. En effet, pour contrer la violence en milieu de travail, sur le plan légal, la Belgique et la France ont interdit les actes de harcèlement et leur répétition, en modifiant et en ajoutant des dispositions pénales dans leurs lois du travail respectives. Le Québec a agi dans le même sens en modifiant sa Loi sur les normes du travail . Toutes ces normes ont en commun d'instaurer un régime de protection en faveur du salarié victime de harcèlement psychologique ou moral. Le fondement de cette protection procède pour une grande part de la promotion des droits fondamentaux de la personne dans l'ordre juridique interne. À titre d'exemple, en droit européen, le harcèlement moral au travail est considéré comme une forme de discrimination portant atteinte au principe d'égalité de traitement en matière d'emploi et de travail . Or, on sait que « la raison d'être principale du droit du travail », ainsi que le soulignent Pierre Verge et Guylaine Vallée, « est de limiter le pouvoir que possède l'employeur sur le salarié » , lequel se manifeste à travers ses droits de direction . Ces droits concèdent à l'employeur une large marge de manœuvre dans la conduite de ses affaires. Il peut ainsi « effectuer des changements de structures de l'entreprise ou d'organisation de travail, modifier les procédés de production, implanter et utiliser des nouvelles technologies, réduire la production ainsi que la main-d'œuvre, etc.» . Il peut aussi prendre toute mesure disciplinaire, y compris congédier tout salarié qui ne se soumettra pas à ses ordres. Comme on le voit, dans plusieurs domaines liés à la gestion de son organisation, l'employeur a longtemps décidé librement . Ainsi, soulever la question de l'interdiction du harcèlement psychologique ou moral au travail sans tenir compte des droits de direction de l'employeur semble remettre en question sa liberté quant à la régulation de son entreprise . Notre objectif en abordant le sujet est de comprendre les justifications qui sous-tendent cette intervention de l'État dans un domaine qui jusqu'alors n'était pas spécifiquement ciblé par le droit et l'impact de cette interdiction sur les droits de direction, afin de confirmer ou infirmer notre hypothèse d'une dynamique de mutation normative interne de l'entreprise impulsée par cette interdiction. Pour y parvenir, nous ferons appel à la méthode d'analyse jurisprudentielle et doctrinale infléchie toutefois par une perspective sociojuridique. Celle-ci nous permettra de comprendre s'il y a eu une transformation de la nature des droits de direction eu égard à la nouvelle donne. Si oui, comment et dans quelle(s) mesure (s), sinon, pourquoi ?

Book excerpt: Le présent mémoire met en relation la protection contre le harcèlement psychologique en milieu de travail, le morcellement de cette protection et les relations de travail tripartites, afin de se pencher sur l'effectivité de la protection contre le harcèlement psychologique dans un contexte de relation de travail tripartite. Les dispositions spécifiques au harcèlement psychologique prévues à la Loi sur les normes du travail se sont superposées à diverses normes préexistantes susceptibles d'être mobilisées par les victimes de harcèlement pour constituer la protection morcelée dont ces travailleurs bénéficient aujourd'hui. Ces dispositions venaient prévoir l'obligation de l'employeur de prévenir et de faire cesser le harcèlement psychologique à l'égard de ses salariés ; elles s'ajoutaient à la panoplie de contraintes juridiques qui lui étaient déjà imposées pour protéger le travailleur contre le harcèlement. On comprend qu'en matière de harcèlement psychologique, l'employeur joue un rôle important dans la protection du salarié. Or, cet employeur est difficile à identifier dans les relations de travail tripartites, où deux entités se partagent les attributs patronaux à l'égard d'un même salarié. Nos lois du travail reconnaissent dans la relation d'emploi un unique employeur et ses salariés, s'étant bâties à partir d'un modèle classique d'entreprise. Déjà que le travailleur qui se trouve dans une relation de travail bipartite est confronté, lorsqu'il est victime de harcèlement, à des difficultés découlant des diverses normes qui sont susceptibles de s'appliquer à lui, la situation se complexifie davantage lorsqu'il se trouve dans une relation tripartite, en raison du défi d'identification de son véritable employeur. Par une revue exploratoire de la jurisprudence, ce mémoire met en évidence l'ineffectivité de la protection contre le harcèlement psychologique dans un contexte tripartite. Il démontre entre autres que les obligations de l'employeur en matière de harcèlement psychologique prévues à la Loi sur les normes du travail sont difficiles à respecter dans une relation tripartite et que l'employeur responsable de protéger le salarié contre le harcèlement n'a pas toujours un contrôle sur le milieu de travail. Il met notamment en lumière le fait que certaines normes à caractère préventif qui ne reposent pas uniquement sur l'employeur ne semblent pas être mobilisées pour la prévention en matière de harcèlement psychologique, alors qu'elles pourraient améliorer la protection des salariés au cœur de relations tripartites.

Although increasing numbers of women have become lawyers in the past decade, Jennifer Pierce discovers that the double standards and sexist attitudes of legal bureaucracies are a continuing problem for women lawyers and paralegals. Working as a paralegal, Pierce did ethnographic research in two law offices, and her depiction of the legal world is quite unlike the glamorized version seen on television. Pierce tellingly portrays the dilemma that female attorneys face: a woman using tough, aggressive tactics—the ideal combative litigator—is often regarded as brash or even obnoxious by her male colleagues. Yet any lack of toughness would mark her as ineffective. Women paralegals also face a double bind in corporate law firms. While lawyers depend on paralegals for important work, they also expect these women—for most paralegals are women—to nurture them and affirm their superior status in the office hierarchy. Paralegals who mother their bosses experience increasing personal exploitation, while those who do not face criticism and professional sanction. Male paralegals, Pierce finds, do not encounter the same difficulties that female paralegals do. Pierce argues that this gendered division of labor benefits men politically, economically, and personally. However, she finds that women lawyers and paralegals develop creative strategies for resisting and disrupting the male-dominated status quo. Her lively narrative and well-argued analysis will be welcomed by anyone interested in today's gender politics and business culture.
