C'est vers ce dernier que la présente étude est orientée. À première vue, l'obligation solidaire paraît se réduire à des mécanismes connus (obligation alternative, fiducie, représentation, cautionnement). L'analyse révèle qu'il n'en est rien. L'obligation solidaire est une institution autonome. Elle puise sa substance dans la notion d'obligation conjointe, pourtant traditionnellement regardée comme son antithèse même. De cet étrange constat, l'Histoire rend compte et livre l'explication. L'opposition ancestrale de l'obligation conjointe et de l'obligation solidaire se trouve de la sorte remise en cause.

C'est vers celui-ci que la présente recherche est orientée. A première vue, l'obligation solidaire apparaît comme un corps hétérogène composé d'une obligation principale et, à hauteur des recours que les cocréanciers ou codébiteurs solidaires peuvent exercer entre eux une fois le paiement effectué, d'une autre institution connue (fiducie, représentation ou cautionnement). L'examen revèle cependant qu'en dépit de quelques concessions à la logique dont ces schémas procèdent, elle ne s'y réduit pas. L'obligation solidaire existe, autonome. Mais elle puise sa substance dans une notion qui est traditionnellement tenue pour son antithèse. Elle n'est en effet rien d'autre qu'une obligation conjointe soustraite à la division que, pour des raisons historiquement claires mais théoriquement obscures, le droit positif français fait en principe subir à cette obligation.
