Les sujets du présent ouvrage portent, plus précisément, sur les éléments du délit de négligence (l'obligation de diligence, la norme de diligence, la causalité factuelle, la proximité causale, le dommage), des certains délits intentionnels et leurs moyens de défense (common law) et sur les éléments de la responsabilité extracontractuelle personnelle (le triptyque classique de la faute-causalité-préjudice/article 1457 CcQ) et ses moyens de défense (droit civil). Chaque sujet est étudié en common law et en droit civil sur la base des lois et/ou la jurisprudence/précédent et doctrine et est accompagné d'une analyse comparée. Une caractéristique qui ne cesse d'apparaître au niveau de tous les thèmes choisis est le fait que dans les deux cultures juridiques il y a des préoccupations communes : tant en common law qu'en droit civil on se préoccupe des comportements négligents et intentionnels ainsi que des moyens de défense disponibles au défendeur en leur présence, on se soucie de la présence d'un préjudice et d'un lien de causalité pour engager la responsabilité du défendeur et on examine l'obligation de diligence entre les parties au litige. La manière qu'on traite ces préoccupations communes au niveau de deux cultures juridiques présente des similarités mais aussi des différences marquantes. Les similarités et divergences de traitement identifiées dans le présent ouvrage démontrent que la convergence des règles applicables est présente mais qu'elle reste relative ou partielle et dépendante de la question particulière qu'on traite. Cette convergence relative ne doit pas être perçue comme une faiblesse du droit applicable mais comme une preuve flagrante à quel point deux cultures juridiques avec une valeur juridique égale au niveau national peuvent coexister au Canada."--
