Selon le degré de précision des droits mis en œuvre, la notion d'abus de droit permet de rappeler (instrument de police) ou de révéler (instrument de bornage) la volonté du législateur, quant à la fonction des prérogatives confiées par celui-ci aux syndicats, aux titres de la présence, comme de l'action syndicale dans l'entreprise. Une fois de tels abus repérés, l'auteur propose un régime de sanctions, qui rende compte de la spécificité de la notion d'abus de droit.
