Book Introduction to Public Law

Download or read book Introduction to Public Law written by Élisabeth Zoller and published by BRILL. This book was released on 2008 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Introduction to Public Law" is a historical and comparative introduction to public law. The book traces back the origins of the "res publica" to Roman law and analyzes the course of its development, first during the monarchical age in continental Europe and England, and then during the republican age that began at the end of the eighteenth century with the democratic revolutions in the United States and France. For each period and country, the book analyzes the major concepts of public law and their transformations: sovereignty, the state, the statute, the separation of powers, the public interest, and administrative justice.

Download or read book The Age of Dignity written by Catherine Dupré and published by Bloomsbury Publishing. This book was released on 2016-02-11 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: Human dignity is one of the most challenging and exciting ideas for lawyers and political philosophers in the twenty-first century. Even though it is rapidly emerging as a core concept across legal systems, and is the first foundational value of the European Union and its overarching human rights commitment under the Lisbon Treaty, human dignity is still little understood and often mistrusted. Based on extensive comparative and cross-disciplinary research, this path-breaking monograph provides an innovative and critical investigation of human dignity's origins, development and above all its potential at the heart of European constitutionalism today. Grounding its analysis in the connections among human dignity, human rights, constitutional law and democracy, this book argues that human dignity's varied and increasing uses point to a deep transformation of European constitutionalism. At its heart are the construction and protection of constitutional time, and the multi-dimensional definition of humanity as human beings, citizens and workers. Anchored in a detailed comparative study of case law, including the two European supranational courts and domestic constitutional courts, especially those of Germany, the UK, France and Hungary, this monograph argues for a new understanding of European constitutionalism as a form of humanism.

Download or read book The End of Sovereignty written by Transatlantic Policy Consortium. Annual Colloquium and published by LIT Verlag Münster. This book was released on 2006 with total page 494 pages. Available in PDF, EPUB and Kindle. Book excerpt: The second volume of the Transatlantic Public Policy Series comprises contributions by members of the Transatlantic Policy Consortium (TPC). The 17 provocative contributions focus on the concept of internal and external sovereignty which is critical on both sides of the Atlantic. It is not easy to articulate the domain and limits of the state's control of its resources, its capacity to coerce activities within its borders, its powers to treat other states as co-equals across a border, or even implement its own defense, trade or regulatory policies. The volume provides a unique insight into these problems from a European and US perspective.

Book Redefining and Combating Poverty

Download or read book Redefining and Combating Poverty written by Council of Europe and published by Council of Europe. This book was released on 2012-01-01 with total page 408 pages. Available in PDF, EPUB and Kindle. Book excerpt: We are at a point in history where economic inequalities are more widespread each day. The situation of extreme poverty experienced by the majority of the populations in developing countries ("Third World" countries) often coincides with an absence of democracy and the violation of the most fundamental rights. But in so-called "First World" countries a non-negligible proportion of inhabitants also live in impoverished conditions (albeit mainly "relative" poverty) and are denied their rights. The European situation, which this publication aims to analyse, is painful: the entire continent is afflicted by increasing poverty and consequently by the erosion of living conditions and social conflicts. The economic and financial crisis has resulted in the loss of millions of jobs, and created job insecurity for many still working. Economic insecurity raises social tensions, aggravating xenophobia, for instance. Yet the economic and financial crisis could present a good opportunity to rethink the economic and social system as a whole. Indeed, poverty in modern societies has never been purely a question of lack of wealth. It is therefore urgent today to devise a new discourse on poverty. In pursuit of this goal, the Council of Europe is following up this publication in the framework of the project "Human rights of people experiencing poverty", co-financed by the European Commission.

Book The Sociology of the State

Download or read book The Sociology of the State written by Bertrand Badie and published by University of Chicago Press. This book was released on 1983-05-15 with total page 183 pages. Available in PDF, EPUB and Kindle. Book excerpt: Too often we think of the modern political state as a universal institution, the inevitable product of History rather than a specific creation of a very particular history. Bertrand Badie and Pierre Birnbaum here persuasively argue that the origin of the state is a social fact, arising out of the peculiar sociohistorical context of Western Europe. Drawing on historical materials and bringing sociological insights to bear on a field long abandoned to jurists and political scientists, the authors lay the foundations for a strikingly original theory of the birth and subsequent diffusion of the state. The book opens with a review of the principal evolutionary theories concerning the origin of the institution proposed by such thinkers as Marx, Durkheim, and Weber. Rejecting these views, the authors set forward and defend their thesis that the state was an "invention" rather than a necessary consequence of any other process. Once invented, the state was disseminated outside its Western European birthplace either through imposition or imitation. The study concludes with concrete analyses of the differences in actual state institutions in France, Prussia, Great Britain, the United States, and Switzerland.
