Cela passe notamment par un encerclement plus strict des professionnels des marchés et des marchés financiers ainsi que par un accroissement du rôle des régulateurs et des sanctions qu'ils peuvent infliger. Et comme les marchés financiers sont interconnectés, aucun d'eux ne réagit de manière totalement indépendante par rapport aux autres, on parle de globalisation des marchés financiers. C'est pourquoi, le droit financier contemporain est profondément ancré dans le droit européen dans la mesure où il est essentiellement issu de la transposition de directives européennes permettant ainsi une coordination intracommunautaire et, à l'avenir, un traitement global des crises.
