Book excerpt: L'intérêt soudain pour les petites entreprises s'explique par l'évolution défavorable de l'emploi dans les grandes entreprises, vers la fin des années 70. Les résultats positifs des petites structures en termes d'emplois, et le constat de leur poids économique et social : 98,8% des entreprises françaises occupent moins de 50 salariés (l'Union européenne compte près de 53 millions de personnes employées dans ces entreprises), contrastent, avec des cadres juridiques peu propices. Le droit du travail retient depuis les origines, l'effectif des entreprises comme critère de référence, mais son adaptation à la situation particulière des PME, consistait pour l'essentiel, à ne pas leur appliquer certaines dispositions. Au mieux, ces structures étaient envisagées pour être assimilées aux grandes entreprises, modèles de base de toutes réflexions juridiques. Néanmoins, la législation française du travail n'allait pas rester imperméable aux influences conjuguées des analyses économiques et juridiques, et de l'effervescence de l'action européenne en faveur des PME. Mais que faut-il entendre par PME ? Avant d'envisager dans le cadre d'une analyse juridique, une législation mieux adaptée, une notion plus réduite, moins fourre-tout s'impose : la petite entreprise. De plus, l'ineffectivité constatée du droit du travail dans ces entreprises, pose la question d'une approche adaptée. La petite entreprise doit-elle être envisagée de manière spécifique, ou bien faut-il la soumettre aux mêmes règles que celles valant pour les grandes entreprises ? Si différenciation normative il y a, doit-elle concerner l'ensemble de la législation du travail, ou bien l'un de ses aspects ? Quelle approche juridique doit-on privilégier ? De telles dérogations au droit commun du travail, font aujourd'hui encore l'objet de controverses et de prises de positions contradictoires, sur lesquelles il était utile et opportun de faire le point dans le cadre d'une recherche approfondie sur l'ensemble de ces questions.
