Les contributions réunies dans ce volume, pour l'essentiel rédigées par des historiens du droit, montrent alors que, pour chacun de ces systèmes, les difficultés liées à la mobilisation, à la conduite des opérations militaires, au maintien de l'activité économique, au fonctionnement de la justice ou encore à la réparation des dommages de guerre, ont souvent été résolues au moyen de techniques pour une bonne part similaires, comme la mise en place d'un contrôle accru des activités économiques au moyen notamment de restrictions à la liberté contractuelle et à la liberté du commerce, le recours à la technique des moratoria ou, au contraire, le maintien de certains grands principes du droit contractuel, spécialement la force obligatoire du contrat. Elles montrent également que cette adaptation des systèmes juridiques au temps de guerre a souvent bénéficié de l'expérience passée (notamment le premier conflit franco-prussien de 1870) et que, sur certains points (réparation des dommages de guerre, encadrement accru du contrat de bail), elle laissera des traces bien après la fin des hostilités. A l'occasion des commémorations du centenaire de la Première Guerre mondiale, l'objectif du colloque " La Grande Guerre et le droit public " organisé à l'Université de Bourgogne en novembre 2015, fut de tenter de répondre à cette question en mesurant l'influence de la Grande Guerre sur les trois grandes branches du droit public : le droit international d'abord, le droit constitutionnel ensuite, le droit administratif enfin. La Première Guerre mondiale fut avant tout un problème de relations entre Etats. Le droit international, qui joua un rôle majeur dans la survenance, le déroulement et le dénouement de la guerre, fut aussi profondément et durablement affecté par ce conflit sans précédent. La Grande Guerre mit également (et inévitablement) à l'épreuve le fonctionnement des institutions politiques de tous les Etats engagés dans le conflit armé. En France, les institutions de la Troisième République n'avaient pas e?té préparées à l'hypothèse d'un conflit d'une telle ampleur. La question des rapports entre les différents organes constitués, ou encore celle des relations entre le pouvoir civil et le pouvoir militaire furent très concrètement agitées et alimentèrent durablement la réflexion de la doctrine publiciste sur l'évolution du fonctionnement des institutions. Quant au droit administratif, il dut s'adapter aux circonstances nouvelles pour permettre à l'administration de faire face aux contraintes résultant de la guerre, la victoire dépendant aussi, très largement, de l'efficacité de l'action administrative pendant la durée du conflit armé. Un siècle plus tard, certaines des règles juridiques alors élaborées, notamment en droit des contrats administratifs, sont encore appliquées.

The military operations against Iraq during the 1990--1991 Kuwait crisis, and, more recently, the events in the former Yugoslavia have added a new dimension to this part of international law. The subject of this book is the reciprocal effect of armed conflict and international economic relations. The rules on visit, search, diversion and capture, instruments such as blockade or the rules on termination or suspension of trade agreements and the law of neutrality provide classic examples. `Traditional' and `classic' do not necessarily mean that these long-standing rules are now invalid. One of the purposes of this book is to examine the state of important rules of international prize law and of fundamental principles of the law of neutrality.
