Il regroupe ce que l'on appelle communément le droit public économique (administration de l'économie et entreprises publiques) et le droit de la commande publique. Cette discipline repose sur trois piliers, que sont les trois positions de l'administration vis-à-vis du monde économique, les trois corpus de règles constituant le droit public des affaires. Tout d'abord, l'administration réglemente, influence, oriente, dirige ou protège le marché et ses opérateurs économiques. C'est la régulation de l'économie, qui renvoie aux prérogatives de l'administration pour limiter, encadrer l'accès au marché, définir sa structure, réglementer son fonctionnement, préserver son caractère concurrentiel et aider les opérateurs. Ensuite, l'Etat ou les autres personnes publiques peuvent être eux-mêmes opérateurs fournisseurs de biens et de services sur le marché. Cette participation au marché est réglée par le régime juridique applicable au secteur public, composé d'entreprises publiques. Enfin, les personnes publiques, en position de demandeurs sur le marché, engagent une relation de collaboration avec les opérateurs économiques, pour satisfaire leurs besoins. Cette collaboration est régie par le droit de la commande publique au sens large, incluant le régime des contrats immobiliers ayant un objet économique. La sixième édition est à jour des réformes récentes du droit de la commande publique (ordonnances n° 2015-899 du 23 juillet 2015 relative aux marchés publics et n° 2016-65 du 29 janvier 2016 relative aux contrats de concessions, textes d'application) et rend compte des premières jurisprudences les mettant en oeuvre. Pour la première fois, le droit public des affaires est abordé sous l'angle des trois fonctions de l'administration vis-à-vis de l'économie, étudiées dans un seul et même ouvrage destiné aussi bien aux étudiants de masters 1 et 2 qu'aux professionnels.

Dans un contexte politique mouvant, la superposition des systèmes juridiques résultant des interventions réglementaires des États, en quête de leur pouvoir discrétionnaire dans la planification des leurs politiques, comme des interventions du droit communautaire dans le cadre de sa propre œuvre d'harmonisation des procédures de passation, vient redéfinir le rôle des politiques sociales et environnementales, tant au sein des objectifs endogènes du droit des marchés publics qu'en dehors de son cadre réglementaire, appelé dans ce cas à servir de levier.

Cette étude s'attache à examiner et comparer la réglementation européenne et nationale au travers des éléments constitutifs et distinctifs de la notion de marchés publics, ses procédures et son contentieux, démontrant la prépondérance du droit européen sur notre droit national.

At the same time, decentralization has resulted in increased responsibilities for local government; but in most cases, institutional reforms were carried out without the transfer of a sufficient level of resources, and local capacities in governance and project management are weak. Which mechanisms will finance these extensive needs, and how will African local governments meet these needs? Specifics on how to finance African cities have not been studied. The actual scale of this market has not been fully grasped. A systemic approach to this market is difficult because of its diversity (country size; institutional context; characteristics of urban network; availability of capital market, currency, etc.) and a lack of data. Donors’ assistance methods in the sector are disparate, marked by disputes between different schools of thought; special-purpose vehicles created by donors operate according to a variety of methods and with wide-ranging and sparsely disseminated results. What is the best way to transform these systems, often antiquated in many respects, into modern financing systems that facilitate access to domestic markets, mobilize local savings and reinforce local government autonomy? There is no single answer to this question in regard to such a variety of institutional and economic contexts. The main objective of the study is to clarify the debates and to enlighten the choices of African decision-makers at local and national level.

Book excerpt: Since the Doi Moi policy of economic renovation was introduced in 1986, Vietnam has undergone deep transformations as a result of the transition to a socialist-oriented market economy. Social and urban transition has taken place in parallel, as urban dynamics were spurred on by Vietnamese public and private stakeholders, and by external agents such as international organizations and international solidarity organizations, experts, consultants and bilateral aid organizations.Here are the results of research carried out by French, Canadian and Vietnamese teams from the north and south of the country on the overarching theme of Vietnamese cities in transition. Some of this research deals with urban dynamics, some with the issues at stake within such dynamics, or with the strategies of the most significant stakeholders in urban transition: civil society, donors within the framework of official aid for development, consultants and international consultancy firms. These projects were carried out between 2001 and 2004 as part of the Urban Research Programme for Development (PRUD), and mainly focus on Hanoi and Ho Chi Minh City, or both in the case of comparative studies.Is there such a thing as a Vietnamese model of an Asian city? It seems that urban transition in Vietnam is not taking place in as radical and abrupt a manner as in China. The country's capacity for absorbing external models, the quest for a third way between state intervention and economic liberalism, and the fact that the country's architectural heritage is taken into account in urban planning, are just some of the reasons for its particularity. The issues addressed in each chapter, as well as the proposals for further research suggested by the contributors, should act as a catalyst for urban research in Vietnam.
