Aborder ce droit à travers une approche pluridisciplinaire, associant droit public, privé, international, européen, et comparative, entre la France et l'Italie, permet une analyse renouvelée. Dans un premier temps, un rappel de la place de l'enfant dans la famille et la société françaises et italiennes à partir du XVIIIème siècle montre comment l'enfant, ne bénéficiant à l'origine que d'une simple protection, s'est vu offrir une certaine autonomie. Le droit de liberté religieuse s'inscrit dans la problématique des droits de l'enfant, car il doit être combiné avec le droit des parents, plus précisément leur droit d'éducation religieuse, conçu dans l'intérêt de l'enfant. Ce droit présente également des spécificités, liées à la particularité des convictions en cause, desquelles découle une problématique indépendante. Dans un second temps, on réalise que, par delà les proclamations du droit de liberté religieuse de l'enfant, notamment par l'article 14 de la Convention internationale des droits de l'enfant, ce droit est dépendant de la volonté des parents et de l'appréciation du juge de sa maturité, rendant son exercice aléatoire. Qu'il s'agisse des conflits entre parents ou de ceux les opposant aux tiers sur l'éducation religieuse de l'enfant, la volonté de l'enfant, même de l'adolescent, est rarement prise en compte. On dresse le même constat quand intervient le facteur religieux pour choisir le parent gardien après séparation ou divorce ou le parent adoptant. A l'école, l'enfant ne bénéficie pas d'une plus grande possibilité d'exercice de sa liberté religieuse. Si l'enfant est donc mieux protégé contre les excès dérivant de la religion de ses parents, il a en revanche peu de possibilités d'exercer de façon autonome son droit. On peut se demander si l'hypothèse de la création d'une majorité religieuse anticipée permettrait de pallier ces faiblesses.

However, is that enough for any child to live better, safer, and healthier? What are the practical effects of this international as well as many national instruments in the everyday life of children? Have there been any outcomes in terms of improvement of their status around the world, and improvement of the conditions under which they live, since the Convention entered into force? In tackling these questions, this work presents a comparative overview of the implementation of the Convention, and evaluates the results achieved.
