Le premier quart du xxie siècle n’est qu’une période de transition qui contribue à faire surgir de nouveaux acteurs au sein de la filière tout en bousculant les anciens repères de la création de valeur. Des services en ligne, par le biais d’outils techniques divers, proposent de la musique en streaming, des plateformes de téléchargement, de l’e-commerce. Ces mutations ont un impact considérable sur les modalités comportementales et d’écoute du public tout en rendant obsolètes les intermédiaires traditionnels. Le droit d’auteur tel qu’il est défini en France depuis la loi n° 57-298 du 11 mars 1957 sur la propriété littéraire et artistique, s’en trouve ébranlé, en même temps que les pratiques des sociétés de gestion des droits. Les fondements du droit d’auteur qui reposent sur les deux premières séries d’articles du Code de la propriété intellectuelle, consacrées à la nature du droit d’auteur et à la protection des œuvres, semblent vaciller. Tandis que subsistent des perspectives de mutation et de changement pour les droits sociaux des artistes, l’évolution de la politique de l’État à travers les lieux dédiés à l’enseignement artistique, de nouveaux terrains de recherche pour les sciences humaines et sociales apparaissent car les médias émergents produisent une nouvelle façon d’appréhender les connaissances et la construction du savoir. Dans le domaine de la musique et plus largement du son, qu’il s’agisse de la captation des musiques et des bruits reproduits et téléchargés jusque dans des lieux aussi singuliers que les enceintes sportives, ou des nouvelles formes de capitalisation et de transmission de la recherche, la nécessité d’un cadre législatif reconsidéré s’impose afin d’éviter la multiplication des recours. En définitive, les perspectives d’avenir dans le domaine juridique se modifient en même temps que le monde change d’échelle, et les contributions des auteurs du présent ouvrage, qui participent pleinement aux thématiques des humanités numériques en construction, s’attachent à en définir les contours et les orientations possibles.

The cases represent a seismic shift in Canadian copyright law, with the Court providing an unequivocal affirmation that copyright exceptions such as fair dealing should be treated as users’ rights, while emphasizing the need for a technology neutral approach to copyright law. The Court’s decisions, which were quickly dubbed the “copyright pentalogy,” included no fees for song previews on services such as iTunes, no additional payment for music included in downloaded video games, and that copying materials for instructional purposes may qualify as fair dealing. The Canadian copyright community soon looked beyond the cases and their litigants and began to debate the larger implications of the decisions. Several issues quickly emerged. This book represents an effort by some of Canada’s leading copyright scholars to begin the process of examining the long-term implications of the copyright pentalogy. The diversity of contributors ensures an equally diverse view on these five cases, contributions are grouped into five parts. Part 1 features three chapters on the standard of review in the courts. Part 2 examines the fair dealing implications of the copyright pentalogy, with five chapters on the evolution of fair dealing and its likely interpretation in the years ahead. Part 3 contains two chapters on technological neutrality, which the Court established as a foundational principle of copyright law. The scope of copyright is assessed in Part 4 with two chapters that canvas the exclusive rights under the copyright and the establishment of new “right” associated with user-generated content. Part 5 features two chapters on copyright collective management and its future in the aftermath of the Court’s decisions.
