Cette crise a poussé le HCR à développer en Europe le concept de protection temporaire. Vincent Cochetel, conseiller juridique du HCR à Paris, rappelle que la protection temporaire, distincte du statut humanitaire, a fait l'objet d'un effort récent de définition. Dans le contexte de fermeture des frontières que connaît l'Europe, elle répond au souci pragmatique d'assurer, en cas d'arrivées massives, la protection des personnes en quête d'asile. Toutefois, pour Christopher Hein, Directeur du Conseil italien pour les réfugiés, la protection temporaire prive les réfugiés qu'elle concerne de l'ensemble des droits contenus dans la Convention de Genève de 1951. A la définition de l'article 1 de la Convention de Genève doit donc être adjointe au niveau européen une définition complémentaire du réfugié permettant la détermination du statut de réfugié pour des groupes entiers et assurant aux réfugiés selon l'article 4 de la Convention et aux réfugiés de facto un même niveau de protection. Enfin, François Julien-Laferrière souligne que la Convention de Genève ne garantit pas l'asile territorial dans un contexte d'urgence et que les statuts humanitaires comme la protection temporaire dépendent du bon vouloir des Etats. En conséquence, une convention européenne sur l'asile, telle que proposée par la CERE (Consultation Européenne sur les Réfugiés et Exilés), s'avère nécessaire.

Book excerpt: Belgium has a unique place in the history of migration in that it was the first among industrialized nations in Continental Europe to develop into an immigrant society. In the nineteenth century Italians, Jews, Poles, Czechs, and North Africans settled in Belgium to work in industry and commerce. They were followed by Russians in the 1920s and Germans in the 1930s who were seeking a safe haven from persecution by totalitarian regimes. In the nineteenth century immigrants were to a larger extent integrated into Belgian society: they were denied political rights but participated on equal terms with Belgians in social life. This changed radically in the twentieth century; by 1940 the rights of aliens were severely curtailed, while those of Belgian citizens, in particular in the social domain, were extended. While the state evolved into a "welfare state" for its citizens it became more of a police state for immigrants. The state only tolerated immigrants who were prepared to carry out those jobs that were shunned by the Belgians. Under the pressure of public opinion, an exception was made in the cases of thousands of Jewish refugees that had fled from Nazi Germany. However, other immigrants were subjected to harsh regulations and in fact became the outcasts of twentieth-century Belgian liberal society. This remarkable study examines in depth and over a long time span how (anti-) alien policies were transformed, resulting in an illiberal exclusion of foreigners at the same time as democratization and the welfare state expanded. In this respect Belgium is certainly not unique but offers an interesting case study of developments that are characteristic for Europe as a whole.

There is little doubt that securing membership status in a given state bequeaths to some a world filled with opportunity and condemns others to a life with little hope. Gaining privileges by such arbitrary criteria as one’s birthplace is discredited in virtually all fields of public life, yet birthright entitlements still dominate our laws when it comes to allotting membership in a state. In The Birthright Lottery, Ayelet Shachar argues that birthright citizenship in an affluent society can be thought of as a form of property inheritance: that is, a valuable entitlement transmitted by law to a restricted group of recipients under conditions that perpetuate the transfer of this prerogative to their heirs. She deploys this fresh perspective to establish that nations need to expand their membership boundaries beyond outdated notions of blood-and-soil in sculpting the body politic. Finally, on the development of migration control in two countries of immigration: the United States and France.
