Consequently, it covers three types of mobilization: solidarity protests against the deportation of refused asylum seekers, refugee activism campaigning for residence rights and inclusion, and restrictive protests against the reception of asylum seekers. By applying both a longitudinal analysis of protest events and a series of in-depth case studies in three immigration countries, this edited volume provides comparative insights into these three types of movement in Austria, Germany, and Switzerland over a time span of twenty-five years. Embedded in concepts of political change, limited state sovereignty, and migration control, the findings shed light on actors, repertoires, and the effects of protest activities. The contributions illustrate how local contexts, national political settings, issue specifics, and social ties lead to distinctly different forms of protest emergence, dynamics, and strategies. Additionally, they give a profound understanding of the mechanisms and constellations that contribute to protest success, both in terms of preventing deportations of individuals as well as changing policies. In sum, this book constitutes a major contribution to empirically informed theoretical reflections on collective contestation in the fields of refugee studies and social protest movements.

Book excerpt: This book recounts France’s responses to refugees from the liberation of Paris in 1944 to the end of the civil wars in the former Yugoslavia in 1995. It questions whether France fulfilled the promise of asylum for those persecuted for the ‘cause of liberty’ made in its Constitution of 1946. Post-war development and the demand for immigrant workers were favourable to refugees from the Communist east, from Franco’s Spain, from Hungary after insurrection of 1956, and later from Latin America and Indochina. Asylum developed nationally in conjunction with international developments, the interventions of the United Nations High Commissioner for Refugees, and the adoption of the 1951 Refugee Convention. Economic ruptures in the 1970s, however, and the appearance of refugees from Asia and Africa, led to the assertion of national priorities and brought about a sense of crisis, and questions about whether France could continue to fulfil its promise.

Book excerpt: The idea that a claim for international protection can be rejected on the basis that the claimant behave 'discreetly' in their country of origin has remained resilient in asylum claims based on sexual orientation, but also other grounds of claim. This is significant because requiring an asylum-seeker to forgo the reason for which they are persecuted questions the very rationale of refugee protection. This book represents the first principled examination of concealment in refugee law. Janna Wessels connects the different strands of the long-standing debate in both common and civil law jurisdictions and scholarship concerning the question of whether and under which circumstances a claimant must conceal to avoid persecution. In so doing, Wessels uncovers a fundamental tension at the core of the refugee concept. By using sexuality as a lens, this study breaks new ground regarding sexual orientation claims and wider issues surrounding the refugee definition.

Book excerpt: The present volume highlights the new challenges of the international protection of refugees fifty years after the adoption of the 1951 Geneva Convention relating to the Status of Refugees. Focusing on the problems faced by Switzerland in the field of international protection of refugees as well as on the specificity of its asylum law and practice, this publication addresses the refugee problem from a national, European and international perspective. The Swiss experience serves to illustrate the wider problematic of on the one hand, the tensions between security, political and humanitarian concerns encountered by refugee-receiving states, and on the other, the need to preserve an international refugee protection regime which remains an essential component of international law and relations for so long as political solutions are not brought to the root causes of refugee exodus. This reflection on the international protection of refugees is organized around four main themes. The first examines Switzerland's response in the past to mass influx, in the light of historical case studies and the evolution of Swiss asylum law and practice. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. The third centres on the wider protection regime currently being forged in Europe to address a broader category of refugees, including solutions for temporary and subsidiary protection. The final theme revolves around return of refugees, including those under the Dayton and recent Kosovo agreements and covers reintegration of returnees, assistance and long-term development. This work is based on papers presented at a colloquium of the Graduate Institute of the International Studies in Geneva which was organised in collaboration with the Office of the United Nations High Commissioner for Refugees as a contribution to the 50th anniversaries of the UNHCR and the Geneva Convention relating to the Status of Refugees.
