En periode de conflit arme, les femmes et les enfants sont consideres comme des populations vulnerables. C'est pourquoi, le DIH leur accorde une attention particuliere a travers des normes de protection. Il est certain que climat qui regne durant cette periode ne favorise pas leur mise en oeuvre. En effet, les protagonistes sont pour la plupart animes par le desir de vaincre l'adversaire plutot que de respecter des regles de protection. Il usent alors de tous les moyens possibles jusqu'a utiliser cette categorie de la population comme des armes de combat. On assiste alors a une recrudescence des violations graves envers les femmes et les enfants. D'autre part il y'a ces acteurs qui, pendant le conflit doivent veiller a l'application desdites regles. Cependant, de nombreux cas ont demontre que ceux la meme qui sont senses proteger les victimes, transgressaient les regles du DIH sur la protection des femmes et des enfants en periode de conflit arme."

Book excerpt: Andreas Wimmer argues that nationalist and ethnic politics have shaped modern societies to a far greater extent than has been acknowledged by social scientists. The modern state governs in the name of a people defined in ethnic and national terms. Democratic participation, equality before the law and protection from arbitrary violence were offered only to the ethnic group in a privileged relationship with the emerging nation-state. Depending on circumstances, the dynamics of exclusion took on different forms. Where nation building was successful , immigrants and ethnic minorities are excluded from full participation; they risk being targets of xenophobia and racism. In weaker states, political closure proceeded along ethnic, rather than national lines and leads to corresponding forms of conflict and violence. In chapters on Mexico, Iraq and Switzerland, Wimmer provides extended case studies that support and contextualise this argument.

Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.

What happens to the history of sovereignty when we reconsider it from a gender perspective ? Political sovereignty has been a major theme in European thought from the very beginning of intellectual reflection on community. Philosophy and political theory, historiography, theology, and literature and the arts have, often in dialogue with one another, sought to represent or recalibrate notions of rule. Yet whatever covenant was imagined, sovereign rule has consistently been figured as a male prerogative While in-depth studies of historical women rulers have proliferated in the past decades, these have not systematically explored how all women rulers throughout the entirety of European culture have had to operate in a context that could not think power as female – except in grotesque terms. Strategic Imaginations demonstrates that this constitutive tension can only be brought out by studying women’s political rule in a comparative and longue durée manner. The book offers a collection of essays that brings together studies of female sovereignty from the Polish-Lithuanian to the British Commonwealth, and from the Middle Ages to the genesis of modern democracy.
