Book The Rio Declaration on Environment and Development

Download or read book The Rio Declaration on Environment and Development written by Jorge E. Viñuales and published by OUP Oxford. This book was released on 2015-02-05 with total page 721 pages. Available in PDF, EPUB and Kindle. Book excerpt: The international community has long grappled with the issue of safeguarding the environment and encouraging sustainable development, often with little result. The 1992 Rio Declaration on Environment and Development was an emphatic attempt to address this issue, setting down 27 key principles for the international community to follow. These principles define the rights of people to sustainable development, and the responsibilities of states to safeguard the common environment. The Rio Declaration established that long term economic progress required a connection to environmental protection. It was designed as an authoritative and comprehensive statement of the principles of sustainable development law, an instrument to take stock of the past international and domestic practice, a guide for the design of new multilateral environmental regimes, and as a reference for litigation. This commentary provides an authoritative and comprehensive overview of the principles of the Declaration, written by over thirty inter-disciplinary contributors, including both leading practitioners and academics. Each principle is analysed in light of its origins and rationale. The book investigates each principle's travaux préparatoires setting out the main points of controversy and the position of different countries or groups. It analyses the scope and dimensions of each principle, providing an in-depth understanding of its legal effects, including whether it can be relied before a domestic or international court. It also assesses the impact of the principles on subsequent soft law and treaty development, as well as domestic and international jurisprudence. The authors demonstrate the ways in which the principles interact with each other, and finally provide a detailed analysis of the shortcomings and future potential of each principle. This book will be of vital importance to practitioners, scholars, and students of international environomental law and sustainable development.

Book The Rise of Responsibility in World Politics

Download or read book The Rise of Responsibility in World Politics written by Hannes Hansen-Magnusson and published by Cambridge University Press. This book was released on 2020-12-17 with total page 291 pages. Available in PDF, EPUB and Kindle. Book excerpt: The concept of responsibility has emerged as central to the study of international politics. This book explores the integral role of responsibility within the context of global crises such as the responsibility to address climate change, manage financial crises, and intervene with political conflicts. Vetterlein and Hansen-Magnusson address responsibility as a conceptual tool in its own right, existing at the intersection of accountability and legitimacy and spanning across governance sectors of the environment, business, and security. This practice-based approach to the study of responsibility maps similarities and difference across policy fields and reveals the diverse moral actors responsible for negotiating responsibility. The emergence of responsibility further implicates underlying moral values and policy-making within the context of global politics. The Rise of Responsibility in World Politics addresses not only individual agency, but also how questions of community play a role in broader negotiations around the meaning of responsibility.

Book The Prevention Principle in International Environmental Law

Download or read book The Prevention Principle in International Environmental Law written by Leslie-Anne Duvic-Paoli and published by Cambridge University Press. This book was released on 2018-05-31 with total page 858 pages. Available in PDF, EPUB and Kindle. Book excerpt: Prevention is recognized as a cornerstone of international environmental law, but this principle remains abstract and elusive in terms of exactly what is required of states to prevent environmental harm. In this illuminating work, Leslie-Anne Duvic-Paoli addresses this issue by offering a systematic, comprehensive assessment in which she clarifies the rationale, content, and scope of the prevention principle while also placing it in a wider legal context. The book offers a detailed analysis of treaty law, custom codification works, and case law before culminating in a conceptualization of prevention based on three definitional traits: 1. Its anticipatory rationale; 2. Its due diligence content; and 3. Its wide spatial scope to protect the environment as a whole. This book should be read by anyone seeking to understand the evolving principle of prevention in international environmental law, and how it increasingly shares common ground with reparation in the arena of compliance control.

Book The Sources of International Law

Download or read book The Sources of International Law written by Hugh Thirlway and published by Oxford University Press. This book was released on 2019-04-03 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: This new edition of Hugh Thirlway's authoritative text provides an introduction to one of the fundamental questions of the discipline: what is, and what is not, a source of international law. Traditionally, treaties between states and state practice were seen as the primary means with which to create international law. However, more recent developments have recognized customary international law, alongside international treaties and instruments, as a key foundation upon which international law is built. This book provides an insightful inquiry into all the recognized, or asserted, sources of international law. It investigates the impact of ethical principles on the creation of international law; whether 'soft law' norms come into being through the same sources as binding international law; and whether jus cogens norms, and those involving rights and obligations erga omnes have a unique place in the creation of international legal norms. It studies the notion of 'general principles of international law' within international law's sub-disciplines, and the evolving relationship between treaty-based law and customary international law. Re-examining the traditional model, it investigates the increasing role of international jurisprudence, and looks at the nature of international organisations and non-state actors as potential new sources of international law. This revised and updated book provides a perfect introduction to the law of sources, as well as innovative perspectives on new developments, making it essential reading for anyone studying or working in international law.

Book Le Droit international de l environnement

Download or read book Le Droit international de l environnement written by Mario Bettati and published by Odile Jacob. This book was released on 2012-08-30 with total page 305 pages. Available in PDF, EPUB and Kindle.

Download or read book Droit international de l environnement 4e dition written by Lavieille Jean-Marc, Delzangles Hubert, Le Bris Catherine and published by Editions Ellipses. This book was released on 2018-01-30 with total page 384 pages. Available in PDF, EPUB and Kindle.

Download or read book Le d veloppement durable et droit international written by Véronique Claerebout and published by . This book was released on 2011 with total page 591 pages. Available in PDF, EPUB and Kindle.
