La situation des pays en développement est examinée de façon approfondie tout comme les différents mécanismes environnementaux à l'échelle régionale et mondiale tels que les accords commerciaux régionaux : La Communauté européenne, l'ALENA et l'APEC, ainsi que les accords environnementaux multilatéraux : CITES, Le Protocole de Montréal et la Convention de Bâle. Compte tenu de l'interdépendance entre le commerce et l'environnement clairement démontrée au cours des plus grandes conférences internationales sur l'environnement et le développement à savoir: Rio, Johannesburg... nous plaidons en faveur de l'adoption des principes des principes clé du développement durable : équité intergénérationnelle, responsabilité commune et différenciée. Ce qui va dans le sens d'un soutien à apporter aux pays en développement afin de leur permettre de faire face à l'interface commerce-environnement. Ainsi nous abordons la question du transfert de technologie et de l'aide financière du Sud vers le Nord. Nous soutenons également qu'il faut une plus grande cohérence entre le système commercial multilatéral et les instruments juridiques internationaux d'environnement afin d'aller efficacement vers un développement durable à l'échelle mondiale. En somme, dans un premier temps, ce travail consiste à revenir sur les rapports des sommets mondiaux en relation avec les concepts qui sous tendent la notion de « développement durable », puis il met en évidence le bien-fondé de certains principes commerciaux pertinents au regard de cet objectif, tout en présentant différents accords multilatéraux d'environnement à titre de confrontation avec les accords commerciaux de l'OMC contenant des dispositions environnementales ainsi que les principes clé du droit de l'OMC. Les concepts et principes pris en compte sont considérés tant du point de vue des propriétés économiques générales que du point de vue écologique ainsi que des difficultés associées à leurs propriétés, étant donné qu'ils souffrent d'un défaut de mise en œuvre. Compte tenu du fait que les études des cas considérés se sont présentés dans une période qui couvrent pour la plupart, plus d'une dizaine d'années, et que les mécanismes divers et variés semblent privilégiés la création de zones d'influence plutôt que le « développement durable » au sens large, ce qui est dû entre autres choses à un manque de cohérence entre les divers instruments, nous faisons quelque propositions en vue de remédier à ce problème. La démarche adoptée ici peut être vue comme le bilan d'un programme de recherche sur l'articulation entre les principes fondamentaux du commerce et ceux du développement durable dans le contexte de l'OMC. Les méthodes utilisées pour rendre compte des phénomènes observés possèdent une double analyse : celle de l'application du droit de l'OMC et celle de la cohérence de celui-ci avec les accords environnementaux multilatéraux et les mécanismes régionaux. Nous faisons également l'analyse de leur mise en œuvre au sein des pays qui en sont parties, tout comme leurs implications pour les PED qui en sont signataires. Cette recherche compte, au moyen d'une analyse critique du droit de l'OMC contribuer au débat en cours dans le communauté internationale sur le rôle que peut jouer le commerce international dans poursuite du développement durable.

Rather, they take place in complex political and social settings, in which individuals and groups with unequal power interact within changing rules as they pursue conflicting interests. The process of these interactions is what this Report calls governance, and the space in which these interactions take place, the policy arena. The capacity of actors to commit and their willingness to cooperate and coordinate to achieve socially desirable goals are what matter for effectiveness. However, who bargains, who is excluded, and what barriers block entry to the policy arena determine the selection and implementation of policies and, consequently, their impact on development outcomes. Exclusion, capture, and clientelism are manifestations of power asymmetries that lead to failures to achieve security, growth, and equity. The distribution of power in society is partly determined by history. Yet, there is room for positive change. This Report reveals that governance can mitigate, even overcome, power asymmetries to bring about more effective policy interventions that achieve sustainable improvements in security, growth, and equity. This happens by shifting the incentives of those with power, reshaping their preferences in favor of good outcomes, and taking into account the interests of previously excluded participants. These changes can come about through bargains among elites and greater citizen engagement, as well as by international actors supporting rules that strengthen coalitions for reform.
