Book excerpt: "RAPPEL - RAPPEL - RAPPEL" L'expression "Modes alternatifs de reglement des conflits" est apparue au milieu des annees 1990 comme un equivalent francais de la notion americaine d'"Alternative Dispute Resolution." Si l'expression est recente, la realite contemporaine qu'elle designe a de tres vieilles racines (droit romain). Les nouveautes s'observent plutot dans l'usage qui est fait de la technique contractuelle: les parties recourent meme de plus en plus a la convention, en amont du litige, comme instrument d'anticipation du reglement de leur differend. Le developpement contemporain des MARC tient a l'effet conjugue de deux facteurs. Ce que l'on nomme la "crise de la justice," caracterisee par l'explosion de la demande judiciaire et l'encombrement des juridictions qui en resulte, explique bien sur l'engouement contemporain pour les MARC. Mais, dans l'affirmation du phenomene, il y a sans doute plus, qui touche a l'evolution des modes de regulation sociale. Le declin du legicentrisme est de nature a favoriser la contractualisation des rapports sociaux, y compris la contractualisation des litiges. Etat d'esprit plus que categorie juridique, les MARC designent, de maniere generale, l'ensemble des procedes conduisant a une solution amiable des conflits, par opposition aux modes juridictionnels, traditionnellement concus comme des modes autoritaires: le juge "tranche" le litige conformement aux regles de droit qui lui sont applicables. Partant de la, le perimetre des MARC est plus ou moins largement defini. D'abord concus comme une alternative a la solution judiciaire du litige, les MARC se sont developpes y compris devant le juge lui-meme, de sorte que ce ne sont plus les modes judiciaires et les modes amiables qu'il faut opposer, mais les modes juridictionnels et les modes alternatifs qui peuvent donc etre judiciaires (conciliation judiciaire, mediation judiciaire, amiable composition judiciaire) aussi bien qu'extrajudiciaires (arbitrage, conciliation et mediation conventionnelles).

Les justiciables ne sont pas « tous coulés dans le même moule » et la possibilité ouverte à ceux-ci de pouvoir choisir la voie judiciaire ou l’un des modes alternatifs, pour régler le conflit auquel ils sont confrontés, constitue assurément un atout. Il n’existe pas une seule et unique manière de résoudre une situation. Vouloir contraindre et forcer les personnes à entreprendre un mode amiable de règlement de leur litige, à l’encontre de leur volonté, nous paraît une attitude rigide et peu soucieuse des besoins fondamentaux des personnes en présence, alors que l’essence même des modes alternatifs est précisément d’offrir une large place à l’écoute de ceux-ci.
