Pratique, parce qu’il ambitionne d’apporter une réponse juridique aux nombreuses questions qui se posent actuellement dans la vie d’un contrat de travail. Il examine dès lors et notamment les critères d’existence du contrat de travail et des autres relations de travail non salariées au regard de la conception nouvelle du lien de subordination distinguant dans les relations de travail, l’autorité juridique et l’autorité économique. Il s’attache à l’analyse des modalités requises à la formation du contrat, aux règles applicables à la responsabilité professionnelle du travailleur, au transfert d’entreprise, aux différentes causes de suspension du contrat de travail et à leurs régimes de protection spécifiques, enfin aux modes de cessation du contrat de travail réglés par le code civil et la loi du 3 juillet 1978 relative aux contrats de travail. L’ouvrage s’attache essentiellement à déterminer les règles légales ou jurisprudentielles qui régissent aujourd’hui le contrat de travail, malmené plus que tout autre contrat de droit commun, par les contingences de la vie économique et ses inévitables répercussions sur la vie contractuelle. La référence de plus en plus fréquente aux règles de droit civil, donc au principe de l’autonomie de la volonté, pour le réglementer, et l’adoption régulière de nouvelles législations ou dispositions insérées dans les lois-programmes en vue de restreindre la protection des travailleurs en sont des exemples frappants. La publication de l’ouvrage vient donc à point.

Nourri de considérations opérationnelles, le droit du travail, qui ne se préoccupe pas de bâtir un droit du contrat de travail, attire ce dernier dans son orbite et accuse la physionomie dérogatoire de sa réglemetnation légale laquelle demeure très imparfaite. L'affirmation renouvelée de la place centrale du contrat dans la relation de travail ne va donc pas sans ambiguïtés. Dans une perspective fonctionnelle, le droit du travail réalise l'agencement original des différents corps de règles applicables; de manière distributive et sur un mode normatif, le juge opère détermination du droit applicable à la relation de travail et assure sa réglementation pragmatique dans l'entreprise, à distance du droit civil des contrats. La dérogation au droit commun se présente donc comme un instrument de soustraction au droit civil des contrats. Mais elle assure aussi la réception du contrat de travail dans le droit civil des contrats. De l'intervention du juge jaillissent en effet des règles qui s'apparentent à la réglementation particulière d'un contrat spécial. Un droit commun du contrat de travail, essentiellement prétorien, s'affermit : tant bien que mal, ses effets normaux apparaissent; place est aussi faite à la dérogation conventionnelle. Enserré par les restrictions légales et jurisprudentielles, l'exercice de la liberté contractuelle est cependant clairement finalisé et encadré. A cet encadrement participe la technique du droit civil des contrats.

Le présent mémoire traite de l'une des manifestations de cette interaction, soit du recours à l'appareil contractuel pour donner ouverture à l'application de certaines lois de protection des travailleurs dans la sphère provinciale au Québec. L'accès aux lois du travail étant réservé aux personnes qui possèdent le statut de « travailleur » ou de « salarié » au sens de ces lois, la façon dont ces notions sont définies par le législateur est importante. Nous étudions dans notre texte l'incidence que le recours à la notion de contrat de travail peut avoir dans ce contexte. Dans la première partie du mémoire, nous étudions le rôle du droit civil dans le développement du droit du travail. Nous nous penchons sur l'existence d'un ensemble de droits et d'obligations rattaché au rapport de travail indépendamment de la volonté des parties. Ensuite, nous présentons les deux fondements possibles du rapport visé par les lois du travail, soit la thèse contractuelle et celle fondée sur la « relation du travail », ainsi que la façon dont elles sont reçues au Québec et ailleurs. Dans la troisième partie de notre texte, nous examinons les effets pratiques d'appliquer les critères du droit des contrats lorsqu'il s'agit d'établir si une personne peut bénéficier des lois du travail à partir de l'analyse de certaines décisions jurisprudentielles. Nous nous penchons de façon plus particulière sur le traitement accordé par les tribunaux aux personnes qui occupent des emplois atypiques comme les travailleurs occasionnels, saisonniers et autonomes. Nous explorons également si une approche fondée sur la réalité factuelle, les particularités du travail en cause et les objectifs des lois d'ordre public peut constituer une piste de solution à la problématique que le recours à la figure contractuelle pour déterminer l'application des lois du travail soulève.
