Book excerpt: Le concours entre conventions et accords collectifs a pour finalité de désigner le texteconventionnel applicable à la relation de travail lorsque plusieurs sont susceptibles de la régirsimultanément. La spécificité de ce mécanisme est de ne pas accorder de priorité àl'application d'un accord collectif. Le concours suppose que l'accord applicable est celuiprésentant un contenu au moins équivalent ou plus favorable que ses concurrents.L'originalité du concours est ainsi de permettre l'application de tout accord, peu importe qu'ilait été conclu au niveau de la branche professionnelle ou de l'entreprise. Toutefois, ce régimeest aujourd'hui limité par la consécration de la prévalence de l'accord d'entreprise, luipermettant de primer l'accord de branche sans avoir à présenter de garanties plus favorablesou équivalentes. La prévalence évince donc le concours, car il n'est plus laissé de place àl'application de l'accord de branche, relégué au rang de norme supplétive qui ne s'appliquequ'à défaut d'accord d'entreprise de même objet. La thèse révèle cependant que, malgré laprévalence de l'accord d'entreprise, le modèle issu du concours se maintient. La possibilité denégocier des accords à différents niveaux persiste et la capacité des accords d'entreprised'empêcher l'application de la convention de branche connaît des limites. Par ailleurs, l'étudepropose d'analyser les rapports entre accords conclus à différents échelons de l'entreprise,pour mettre en lumière la survenance de configurations renouvelées de concours.

Gerät damit das britische und nicht das deutsche Modell zum Orientierungspunkt einer Ausgestaltung des «sozialen Dialogs» in Europa? Der vorliegende Band, der Beiträge von Arbeitsrechtlern, Sozialwissenschaftlern sowie von Vertretern von Unternehmerverbänden und Gewerkschaften enthält, soll Orientierungspunkte für die Beantwortung dieser Frage liefern. Les directives européennes, qui respectent les traditions des Etats-membres d'Europe occidentale, doivent servir, dans le cadre de l'élargissement de l'UE, à garantir des standards minimaux en droit social dans les pays nouvellement intégrés, notamment en accordant des droits d'information et de consultation aux salariés. Cela conduit-il au transfert d'un certain type de « modèle européen » de participation des salariés aux processus décisionnels des entreprises ? Or, il n'existe pas en la matière de modèle unique en Europe de l'Ouest. La discussion relative à l'harmonisation des droits des salariés en Europe est donc marquée par l'existence parallèle de différentes traditions nationales. Les études présentées dans cet ouvrage révèlent que la tendance est aux systèmes de représentation d'émanation syndicale. Ne serait-ce donc pas plutôt le système britannique que le système allemand qui servirait désormais de référence dans l'élaboration d'un « dialogue social » en Europe ? Des spécialistes du droit du travail et des sciences sociales ainsi que des représentants d'organisations patronales et syndicales, proposent ici des points de repère pour analyser ce phénomène.
