L'annulation ne constitue le plus souvent qu'une étape, et la solution du litige ne sera parfaite qu'avec la matérialisation du droit que le juge consacre. Le commandement est un instrument objectif de réalisation de la fonction juridictionnelle, puisque le juge ne statue pas directement sur les droits du requérant à obtenir un avantage mais sur les conséquences de l'annulation. Pourtant, en même temps qu'il satisfait l'exercice de la fonction juridictionnelle l'emploi du commandement implique un élargissement du contrôle juridictionnel en direction des droits subjectifs. Au fur et à mesure que les pouvoirs du juge se propagent la logique interne de ses pouvoirs l'emporte sur leur fonction strictement instrumentale. L'usage des pouvoirs de commandement, en particulier dans l'office du juge de l'excès de pouvoir, provoque une distorsion des logiques et des raisonnements connus en droit administratif. Cette évolution bouleverse la physionomie du recours pour excès de pouvoir et heurte profondément les enseignements juridiques classiques. Le contentieux de l'annulation semble prendre de nouvelles formes. La justification idéologique du jugement d'excès de pouvoir comme étant le " procès fait à un acte " ne correspond plus à la réalité contentieuse. Les représentations traditionnelles du contentieux administratif et en particulier les classifications usuelles, sont désormais périmées. Il nous faut dès lors imaginer de nouvelles classifications reposant sur une voie alternative au recours pour excès de pouvoir, mieux à même de répondre aux exigences du contentieux administratif contemporain.
