Le complesse relazioni che intercorrono tra la disciplina degli appalti, anche nel settore pubblico, e la tutela del lavoro sono da sempre all’attenzione degli studiosi, ma i contributi raccolti nel presente volume si prefiggono soprattutto di “mettere a fuoco” le problematiche più attuali, prendendo in esame le numerose novità che, incessantemente, provengono dall’evoluzione dell’ordinamento che è alla costante ricerca di un equilibrato bilanciamento tra l’interesse dell’impresa ad una organizzazione efficiente e competitiva e l’interesse del lavoratore alla conservazione dell’occupazione e alla garanzia dei propri diritti. Particolare attenzione è, così, rivolta alle molteplici novità che emergono dalla legge (ad esempio, la recentissima modifica all’art. 105, comma 14, del Testo Unico sugli appalti pubblici), dalla contrattazione collettiva (con l’intensa opera di adattamento e perfezionamento delle clausole sociali), e da altre istituzioni (con gli interventi dell’ANAC, ancora in tema di appalti pubblici, e della Commissione di Garanzia sugli scioperi nei servizi pubblici essenziali), nonché dalla giurisprudenza (con alcune interessanti pronunzie, tra le altre, in materia di decadenza contributiva e in materia di appalti nelle società pubbliche). Emergono, inoltre, dalla pluralità delle opinioni, approfondimenti utili anche per riflettere sui più rilevanti aspetti teorico-sistematici, in particolare per ciò che attiene alle sempre fibrillanti discussioni sulla nozione di subordinazione e sulle tecniche di tutela degli interessi implicati, nonché sulle prospettive de iure condendo.

Book excerpt: La disciplina degli appalti, specie di quelli pubblici, occupa stabilmente un posto di rilievo nell’agenda del nostro legislatore, impegnato a garantire la trasparenza dell’attività amministrativa e al contempo la concorrenza tra imprese e la libertà di stabilimento, in ossequio ai principi dell’Unione Europea. Ed infatti, il novellato codice dei contratti pubblici (d.lgs. 18 aprile 2016, n. 50), costituisce attuazione di tre direttive UE del 2014 (nn. 23, 24 e 25). Molte le novità rispetto al codice del 2006 (d.lgs. 12 aprile 2006, n. 163). Una particolare attenzione viene riservata dal codice alla tutela dei lavoratori impiegati negli appalti attraverso le clausole sociali di prima e di seconda generazione, destinate a garantire le prime il trattamento economico e le seconde la continuità occupazionale di questa ormai vasta categoria di lavoratori, con l’obiettivo di realizzare attraverso la tutela di questi ultimi anche quella della concorrenza tra imprese, evitando fenomeni di dumping sociale. L’analisi del fenomeno e la sua impostazione di fondo si riflettono nel titolo dell’opera “Appalti e lavoro”. Alla sua realizzazione hanno concorso studiosi ed esperti delle due discipline che si contendono la materia, il diritto amministrativo e il diritto del lavoro, chiamati ciascuno per le proprie competenze a dialogare tra di loro. Ne è derivato un confronto fecondo e serrato, che si è mantenuto costantemente ancorato al fenomeno e alle molteplici problematiche che esso pone agli operatori del diritto, dando a chi legge la netta sensazione di una riflessione sviluppata stando dentro il fenomeno e non al di fuori. L’opera “Appalti e lavoro” è articolata in due volumi dedicati rispettivamente il primo ai profili pubblicistici e il secondo a quelli più specificatamente lavoristici, ma con continue intersezioni tra gli stessi, specie nel volume primo. I settanta saggi, alla cui redazione hanno contribuito cinquanta esperti, accademici e non si rivolgono a tutti gli operatori del diritto che si occupano della materia con uno stile chiaro e diretto coniugato ad un metodo di analisi rigoroso.Domenico Garofalo è professore ordinario di diritto del lavoro nell’Università degli Studi di Bari e avvocato cassazionista. È autore di varie monografie e di oltre duecento saggi nonché curatore di numerose opere collettanee, sulle tematiche lavoristiche e previdenziali. Collabora da oltre venticinque anni con la categoria dei consulenti del lavoro curandone la formazione permanente. È socio dell’Aidlass e socio fondatore del Centro Studi Domenico Napoletano – sezione di Bari.
