Dès lors, il a paru opportun de consacrer une étude d'ensemble au sort du contrat de bail commercial dans le cadre du redressement ou de la liquidation judiciaires du preneur, mais aussi du bailleur. En cas de procédure collective du preneur, le bail doit-il être résilié ou continué ? Quand, comment et pour quelles raisons le bailleur peut-il obtenir la résiliation du bail et quelles sont les modalités de paiement de sa créance de loyers et charges ? Par ailleurs, quel est le sort du bail dans le plan de continuation ou de cession et que devient-il en phase liquidative ? En cas de procédure collective du bailleur, hypothèse que le législateur n'a manifestement pas envisagée, doit-on faire bénéficier le bailleur des règles édictées pour le preneur au risque d'aboutir à des solutions iniques pour ce dernier, tant sur le plan de la résiliation du bail que sur celui de l'indemnité d'éviction ?
