Book Commercial Dispute Processing and Japan

Download or read book Commercial Dispute Processing and Japan written by Yasunobu Sato and published by Kluwer Law International B.V.. This book was released on 2001-08-29 with total page 458 pages. Available in PDF, EPUB and Kindle. Book excerpt: Under globalization, the resolution of commercial disputes across national borders is assuming ever greater importance. This groundbreaking study explores a range of possible approaches, both within the established legal infrastructure, and through alternative, not only arbitration, but also non-confrontational means such as negotiation and mediation/conciliation. The Japanese experience in dispute processing is taken as a means of exploring the ways in which international harmonization efforts such as the UNCITRAL Model Law impact on individual nations. As an Asian nation which has adopted and adapted a variety of Western practices under modernization and democratization, Japan is in a unique position to offer a balanced global example--a model for a more comprehensive approach to disputes as an integrated multi-layered system. The book will be of interest to the scholar and practitioner of trans-national/cultural commercial dispute processing as well as those who are involved in the law reform technical cooperation.

Book The International Commission of Jurists

Download or read book The International Commission of Jurists written by Lucian G. Weeramantry and published by BRILL. This book was released on 2021-10-18 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: The object of this volume is to present a comprehensive survey of the early history and activities of the International Commission of Jurists, highlighting its achievements in defining, developing, and promoting the Rule of Law. It seeks to give readers an awareness of the Commission's unique role in the evolution of the Rule of Law concept, which is not otherwise available. While there were several international organizations, including the Commission, working in the field of human rights following upon the adoption of the Universal Declaration, the Commission was unique in that it focused on the development of the Rule of Law as a sine qua non for the protection and advancement of human rights. The scope of this work is therefore much wider than mere identification and promotion of human rights. It deals with the principles identified by the Commission as underlying the Rule of Law and the institutions and procedure necessary to safeguard those principles; it reviews in-depth studies by eminent jurists on aspects of the Rule of Law; it surveys applications and violations of the Rule of Law in different countries or regions of the world; and it draws attention to trials of persons arrested or detained under cover of legislation patently offending against the Rule of Law. The work also covers the many initiatives taken by the Commission either by itself or in collaboration with the United Nations and other international organizations to ensure better recognition of and respect for the Rule of Law and human rights. Reference is made in this connection to different initiatives of national sections both at the regional and national level.

Book The Developing World of Arbitration

Download or read book The Developing World of Arbitration written by Anselmo Reyes and published by Bloomsbury Publishing. This book was released on 2018-02-22 with total page 545 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Developing World of Arbitration studies the recent emergence of Asia Pacific jurisdictions as regional or international arbitration centres, thanks to various reform efforts and initiatives. This book provides an up-to-date and comprehensive analysis of the ways in which arbitration law and practice have recently been reformed in Asia Pacific jurisdictions. Leading contributors across the Asia Pacific region analyse twelve major jurisdictions representing varying patterns and degrees of development, whether driven from top down, bottom up, or by some hybrid impetus. Setting the arbitration systems and reforms of each investigated jurisdiction in the context of its economic, political, and judicial dynamics, this book presents, for the first-time, a cross-jurisdiction comparative and contextual study of the developing world of arbitration in the Asia Pacific and contributes to comparative international arbitration literature from an Eastern perspective. It also aims to identify an Asia Pacific model of arbitration modernisation, one that may be distinct from a Western model, and predicts future trajectories of development and challenge in light of the ever increasing competition between Eastern- and Western-based arbitration centres. This edited collection will be an invaluable addition to the libraries of academics and practitioners in the field of international commercial arbitration.
