That all owners of roads already constructed, .o, be or in course of construction, within the territory of Nevada, centslwrs=dat the time of the passage of this act, be, and are hereby authorized to collect toll upon such roads, at such rates as may be established by the commissioners of the counties through which such roads may run. SEC. 2. Until such commissioners shall have been elected in the several counties, the rates of toll to be collected shall iiiiiiiiiillecluie remain as established by such road owners at the date of the f, ' _"'h passage of this act, except those that have special charters in the territory of Nevada; provided, they conform with such charter. SEO. 3. This act shall take effect immediately after its pas sage. CHAP. XCVII.--An Act to Fia: the Salary of the Zerritorial Superintendent of Public Instruction. Approved November 29, 1861. Be it enacted, by the Governor and Legislative Assembly of the Territory of 1Vevada, as follows: mm SECTION 1. The salary of the territorial superintendent of authorized. public instruction, shall be the sum of twelve hundred dollars per year, to be paid quarterly, out of' any money in the territorial treasury not otherwise specially appropriated by law. Excerpt: ...represent, that the rapidly increasing population of the Territory, as well as the great value of its agricultural and timber lands, render it not only necessary but indispensable to our prosperity that the Government Lands which are suitable for settlemeht should be surveyed and brought into market' at any early day. The increasing value of these lands, and the immense value of improvements already made in many localities, demand an early adjustment of title. Your memorialists would represent that, during the continuance of the oflice of Surveyor-General in this Territory, all was accomplished that could be done with the amount appropriated for the work under its control but that there is the same necessity of surveys in other localities as upon the lands already surveyed. Your memorialists would further represent, that the Land Oflice established in the Territory will be rendered far less serviceable to the public if the surveys of the Public Lands are not commensurate with the public demand. Your memorialists therefore respectfully ask that an approriation be made for the completion of the survey of the Public ands of this Territory, with a view to their being brought into market at the earliest possible moment. The superintendent shall visit all the schools in his county, at least once a year he shall give such information and encouragement as he may think necessary, and endeavor to promote the introduction of a good and uniform system of school books throughout the county. Sec. 8, It shall be the duty of the superintendent to re ceive the district reports hereinafter provided for, and keep them on file in his office; 'and he shall, on or before the first day of December of each year, make out from the district reports, a statement of the number of scholars in the county, the num ber of school libraries, the number of school houses, the number of districts in how many districts a school has been kept in the past year; what school books are principally used; what pro portion of all the scholars in the county have attended school for the past year, and the amount of money paid to teachers. This statement, together with such other information and sug gestions as he may deem important to the cause of education, he shall file in his office, and may, if convenient, publish it in some newspaper in this Territory.
