Book excerpt: Excerpt from Indian Affairs, Vol. 3: Laws and Treaties; (Laws) Compiled to December 1, 1913 I have the honor to present to the Congress, in compliance with its resolution, the third volume of my compilation of Indian Laws and Treaties. The former volumes were first published under a resolution of the Senate in 1902, and shortly thereafter a second edition was ordered by a concurrent resolution of the two Houses. This third volume brings down to date all laws relative to Indian affairs passed by Congress since 1902 together with all Executive proclamations, departmental orders, etc., relating to Indian reservations to date, a list of Indian trust funds standing to the credit of various tribes, and also several old Indian treaties which it was not possible to procure when the volume containing the treaties was prepared. It was the compiler's purpose when he began the work on the third volume to make it superior, if possible, to the first two volumes, and thinks he has succeeded at least in making it more comprehensive and useful by inserting annotations and citations from the opinions of the Supreme Court of the United States, the Federal and State Courts, the Court of Claims, the Interior Department, the Attorney General, and the Comptroller of the Treasury, wherever it was found that the laws had been construed. In addition, the compiler was successful in obtaining the consent of the publishers of the Cyclopedia of Law and Procedure (cyc) to allow the reprinting in the third volume of the article on Indians, which covers fully and completely the general law relating to Indians and will be found extremely useful as a ready reference. This, in connection with the annotations and the citations to court decisions and a thorough index will enable the freest investigation of any question relating to Indians and Indian affairs. The jurisdictional and territorial rights or claims of the native Indians were scarcely distinguishable from each other. Both were in the tribe or community, and individual possessions in lands were scarcely known. As the life of the Indian is ambulatory, his occupation of the land was transient and for temporary purposes, and common to others with him self. The treaties of cession by the chiefs or head men, with the consent of the tribe, and the charters of the European dis coverers, ceding the territory and jurisdiction to the colony and prescribing the rules of individual right - have so perfected the titles in Maine, that we have very little reason to discuss their origin. By a recurrence to the origin of our political institutions, we are struck with the singular fact that nearly all the charters which form the basis of our liberties emanated from the three first sovereigns of the House of Stuart - a family not much distinguished for their respect for popular rights. Book excerpt: Excerpt from Rules and Regulations: Relating to the Issuance of Patents in Fee and Certificates of Competency and the Sale of Allotted and Inherited Indian Lands Except Those Belonging to the Five Civilized Tribes Any Indian of 21 years or over who holds an allotment of land under a trust patent can - (1) Procure a patent in fee under the act of May 8, 1906 (34 Stat., 182), provided it is shown that he is competent to care for his affairs. (2) Devise his lands by will under the act of June 25, 1910 (36 Stat., 855), provided the land is not located in Oklahoma. (3) Sell his land under the act of March 1, 1907 (34 Stat., 1015-1018). Patents in Fee. Patents in Fee to Indian Allottees. The act of May 8, 1906 (34 Stat., 182), provides that the Secretary of the Interior may, whenever he shall be satisfied that any Indian allottee is capable of managing his or her affairs, cause to be issued to such allottee a patent in fee. This act does not apply to members of the Five Civilized Tribes or the Indians under the jurisdiction of the Quapaw, Kaw, or Osage agencies. The issuance of a fee patent under this act is discretionary with the Secretary of the Interior, and the chief question involved is the degree of competency shown by the allottee to care for his own affairs. All applications for patents in fee under this act should be made on Form 5-105 to the superintendent having jurisdiction over the land the allottee seeks to have patented. The trust patent should accompany the application; or in case the trust patent has been lost or destroyed, affidavit of the allottee to that effect should accompany the application. When an application has been received from an allottee the superintendent will post notices in conspicuous places on the reservation where the applicant is known, using Form 5-189. At the expiration of thirty days after notices have been posted the superintendent will forward the application to the Commissioner of Indian Affairs, Washington, D. C., reporting fully as to the competency of the applicant, giving in detail the reasons for his recommendations, using Form 5-106. Patents in Fee to Heirs. The issuance of a patent in fee to the competent heirs of a deceased allottee is authorized by the acts of Congress approved May 29, 1908 (35 Stat., 444), and June 25, 1910 (36 Stat., 855). Book excerpt: Excerpt from A Brief Statement of the Rights of the Seneca Indians in the State of New York: To Their Lands in That State; With Decisions Relative Thereto by the State and United States Courts, and Extracts From United States Laws, &C The principal design of the Committee of the Society of Friends in preparing the annexed statement, is to show the Seneca Indians in the State of New York, the character of the title to the lands they occupy under the decisions of the Courts of the United States, and the Courts of the State of New York. It is known to them that the Government considers all Indians its wards, and as such, under its special protection and oversight. It has charge of their funds, and the annuities they are entitled to are annually paid to them by its officers appointed for the purpose. The history of the origin of the right which certain citizens of the United States have to extinguish, by purchase, the title of the Seneca Indians to their reservations, when they are willing to sell them, has been derived from authentic sources, and is printed, with the legal decisions respecting it, in order to give them a clear understanding of that right. It appears from the decisions of the Courts, as well as the articles of the treaty of 1794, quoted therein, that the Indian occupants cannot be deprived of their lands without their consent. They are to remain theirs until they choose to sell them, and they are not subject to taxation of any kind. The extracts from laws and decisions of Courts, which are added, contain information respecting their rights. They have had wars with the United States, which have been termina ted by treaties of peace they have never been regarded as traitors in such wars, which they must have been, if they were citizens of the United States; but on the contrary, the treaties of peace, which have followed such wars have borne all the characters, and have contained all the stipula tions which are usual in such treaties, when made between two sovereign nations who have been engaged in war.
