For its starting point this section contends that the law is shaped and reshaped by ever-changing material structures in society. Simultaneously the law works back on these structures to reinforce and conserve them. This materialist thesis is substantiated by an analysis of legal developments in a series of political fields: the development of penal law, financial law and labour protection law amongst others. A close scrutiny of the social organization of the 'legal superstructure', including an amusing and telling analysis of the modes of behaviour of those at the summit of the legal profession, concludes the first section. The dependence of law on the material structure of society cannot be satisfactorily accounted for, however, without also examining the relationship between the law and other systems of ideas, and between those ideas and the social formation in which they appear. Accordingly the central part of this book considers also religion, art and science. The author distinguishes between 'superconstructing' or conserving idea systems and those which enter into a truly dialectical relationship with the material structure to produce a new totality. He argues that in the late capitalist social formation the law is superconstructing whereas science has a dialectical relationship with the world. It remains, however, a political question whether or not dialectical ideas systems are desirable, that is, repression-abolishing. In the final section Mathiesen identifies reform or revolution as a false dichotomy which must be transcended. These chapters are aimed at revitalizing a flagging radical political movement through coherent and cogent discussion of organization and political strategy. In this part of the book the author developes further the notion of the 'unfinished political movement', first conceived in his earlier work The Politics of Abolition (Martin Robertson, 1974). This volume has direct relevance to a broad field of social and political scientists and workers. In particular it should be read by sociologists, social workers, criminologists, lawyers and law students. In addition, these same individuals call upon certain societal institutions to adjust the con flicting claims of different individuals and groups. In this regard, a society is perceived as both a cooperative venture for mutual advantage where there are an identity of interests and, as well, an arena of conflict where there exists a mutual interdependence of conflicting claims or interests. The manner in which a society structures its political-legal-economic institutions 1) to enhance the scope of its cooperative endeavors and 2) to channel internal political-legal-economic conflicts toward resolution, shapes the character of economic life in that society. In contemplating the structure of its institutions intended to promote cooperation and channel conflict, a society confronts several issues. At the most general level an enduring issue is how a society both perceives and then ideologically transmits (perhaps teaches or rationalizes), inter nally and/or externally, its perceptions of so-called "cooperative en deavors" and "arenas of conflict." There can be no doubt that the resultant structure of a society's institutions will reflect that society's perception as to what cooperation entails and what conflict constitutes.

Book excerpt: In analyzing the socio-psychic nature and operations of intuitive legal rules, Petrazycki formulates a theory of law around five conceptual themes: anti-formalism, imperative-attributive legal relationships, law's functional control, law's subjective reality and morality. Petrazycki presents the two ways by which law coordinates and regulates social conduct as through its distributive and organizing functions. Law and Morality has a basic objective: to analyze interrelations between positive and intuitive law. Petrazycki's socio-psychic orientation toward law is behavioral as well as thoughtful. He finds the most suitable methods for obtaining knowledge about legal experiences to be internal and external observation. His technique of introspection is similar to Max Weber's conceptual method. Petrazycki distinguishes between two kinds of interpretive understanding. External observation involves deriving the meaning of an act or symbolic expression from immediate observation without reference to any broader context, and internal observation involves placing the particular act in a broader context of meaning involving facts that cannot be derived from a particular act or expression. Petrazycki's socio-legal ideas remain relevant in today's society. His arguments concerning the global expansion of human love have an attraction for those working towards a better world. In the context of positive psychology and the growing happiness industry, Petrazycki's ideas will compel legal scholars to consider his arguments. Petrazycki's work stands out for the scientific ambitions and systematic nature of his thought as well as the influence of his work on later scholars in the sociology of law.
