Book excerpt: The 1960s, in retrospect, may be chiefly remembered for the unprecedented constitutional developments it witnessed in countries emerging from colonial rule. Originally published in 1963, an examination of these constitutional developments from the authoritative pens of the previous Legal Adviser to the Colonial and Commonwealth Relations Offices, and the Legal Adviser to the Colonial Office at the time was, therefore, particularly timely – for no two men in human history can have had to draft so many constitutional instruments. One after another of these new constitutions had, moreover, included certain ‘Fundamental Rights’, so a discussion of this subject by a recognised academic authority, together with an examination by an ex-Chief Justice of Allahabad of the constitutional writs which have been so widely used in India to protect these rights, was particularly appropriate. An erudite examination of the origins of the famous phrase ‘Justice, Equity and Good Conscience’ by the Reader in Oriental Laws in the University of London, fittingly concludes the first half of this volume. Legal developments in these emergent countries, had, however, by no means been limited to the sphere of constitutional law. So the series continues with contributions on the legal profession in African territories, by a former President of the Law Society, and on the problems posed by Islamic law in that continent, by the Professor of Oriental Laws. Criminal Law is represented by a consideration of ‘Liability under the Nigerian Criminal Code’ by an ex-Chief Justice of the Western Region; matters economic and sociological by papers on ‘Legal Development and Economic Growth in Africa’ and ‘Women’s Status and Law Reform’ by two experts in Africa law; and developments in Asia by an examination of recent legislation on family law in Pakistan, and of the sources of Chinese Law in Hong Kong, by other members of the staff of the School of Oriental and African Studies.

In 2000 and 2001, twelve northern states of the Federal Republic of Nigeria introduced Islamic criminal law as one of a number of measures aiming at "reintroducing the shari'a." Immediately after its adoption, defendants were sentenced to death by stoning or to amputation of the hand. Apart from a few well publicised trials, however, the number and nature of cases tried under Islamic criminal law are little known. Based on a sample of trials, the present thesis discusses the introduction of Islamic criminal law and the evolution of judicial practice within the regions historical, cultural, political and religious context. The introduction of Islamic criminal law was initiated by politicians and supported by Muslim reform groups, but its potential effects were soon mitigated on higher judicial levels and aspects of the law were contained by local administrators. Book excerpt: The current SharÊ'ah legal framework as administered in Northern Nigeria has been in existence since long period of its ancient history. It went through distinct dimensions throughout the chronicles of its legal aggregate, starting from the pre colonial era, via the colonial epoch, up to the post independence eon. Buttressed by this SharÊ'ah framework, polygamy remains a crucial issue of Islamic family law, owing to its ample practice in Nigeria. Religion and culture are the main reasons behind its overwhelming acceptability and widespread. The religious background on polygamy undoubtedly correlated with the cultural position of the Nigerian people, thereby significantly influencing its practice. Besides overheating the controversies surrounding the practice, it is rightly argued that the mix-up of religion and culture rendered the practice inconsistent with the religious principles and its objectives in polygamy. This phenomenon posited the Nigerian framework incompatible with the contemporary developments in the legal framework of polygamous practices around the Muslim world. The main remonstrance surrounding the inconsistent practice is its pessimistic impact on the rights of women which Islamic law overwhelmingly protects. The Nigerian SharÊ'ah framework with respect to family law generally, and on polygamy in particular, is mainly based on uncodified and unregulated classical law of the Maliki School. The non codified system is seen as an efficacious factor responsible for numerous socio-legal botherations linked to polygamous practice in Nigeria. This thesis lucubrates the practice of polygamy in Nigeria and how it affects the rights of women in the Northern Nigerian states. It presents an in-depth study of the classical Maliki law and to what extent is the Nigerian practice compatible with the law. The methodology employed the library-based doctrinal research approach as well as both quantitative and qualitative empirical research approach. Bauchi state was coherently selected as a model of case study for empirical research about the practice of polygamy in Northern Nigeria. For the purpose of presenting a comparative overview of model jurisdictions, the thesis canvasses upon a concise but comprehensive appraisal of the legal framework and practice of polygamy in selected Muslim countries. It concludes with a sum-up of the thesis and a recapitulation of its salient findings and sets forth the author's suggestions. The research is aimed at proposing for the review and gradual reform in the administration of Islamic family law for an arrayed and improved SharÊ'ah implementation in Bauchi state and Nigeria at large.
