Legal reform in these countries is the project of the political elite to improve the legal system while retaining its core socialist principles. It is carried out through legislative enactments, amendments, and replacements, which the political elite adopt using incremental strategies to reform the legal system sporadically or systematically. Socialist legal reform is animated by the political aspiration to create the rule of law, the impact of social-economic change, and the influence of transnational and comparative law. Despite significant reforms, the socialist principles of the legal systems in these countries largely remain intact. This legal reform, however, varies considerably by country. In recent years, the relationship between the two Koreas has been generating more concern than in earlier times. This new interest has been followed by two epoch-making developments over the past decade: the conclusion of the Basic Agreement of 1991 and the Declaration of the North-South Summit of 2000. These events have caused remarkable changes in political, as well as economic, relations between the north and the south. This book reviews the current legal regime and the setting up of a positive legal framework for inter-Korean economic cooperation, beginning to be regulated by international law. This research provides two ultimate outcomes. One is to resolve the legal problems for transnational economic cooperation relating to North and South Korea; the other is to develop a juridical model of south-north cooperation as a new world economic framework for the 21st century. Three interrelated areas are involved in this work. The first part describes the external environmental factors regarding inter-Korean economic cooperation from an international legal perspective. The second part deals with the legal framework of inter-Korean economic cooperation, examining concrete issues arising from practical economic exchanges and cooperation between the two Koreas. The last part discusses the legal foundations for inter-Korean economic integration beyond economic cooperation. This book clarifies the significance of the legal environment as an indispensable servant for the parts of a divided country to recover their relationship, offering both a normative and practical framework.

It provides a valuable ranking of U.S. interests, and calls for a firm commitment from the Obama administration to seek denuclearization of the Korean peninsula, backed by a combination of sanctions, incentives, and sustained political pressure, in addition to increased efforts to contain proliferation. It notes that China's participation in this effort is vital. Indeed, the report makes clear that any hope of North Korea's dismantling its nuclear program rests on China's willingness to take a strong stance. For denuclearization to proceed, China must acknowledge that the long-term hazard of a nuclear Korea is more perilous to it and the region than the short-term risk of instability. The report also recognizes that robust relations between Washington and its allies in the region, Japan and South Korea, must underpin any efforts to deal with the North Korean problem. It looks as well at regime change and scenarios that could lead to reunification of the peninsula. At the same time that the Task Force emphasizes the danger and urgency of North Korea's behavior, it recognizes and applauds the beneficial U.S. relationship with South Korea, which has proved to be a valuable economic and strategic partner. In this vein, the Task Force advocates continued close coordination with Seoul and urges prompt congressional passage of the U.S.-South Korea free trade agreement.
