Book Legal Translation and the Dictionary

Download or read book Legal Translation and the Dictionary written by Marta Chromá and published by Walter de Gruyter. This book was released on 2013-10-10 with total page 132 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study concentrates on three major issues creating a basis for the making of the "Czech-English Law Dictionary with Explanations", namely language, including terminology, in both the Czech and Anglo-American systems of law; the process of legal translation; and the lexicographic method of producing a bilingual law dictionary. Terminology has been considered the most significant feature of language for legal purposes. It encompasses a wide range of special-purpose vocabulary and higher syntactic units, including legal jargon. Conceptual analysis is to be pursued whenever an identical term in the target language does not exist or its full equivalent is in doubt. Legal translation should be based primarily on comparative legal, linguistic and genre analysis in order to make the transfer of legal information as precise, accurate and comprehensible as possible. The primary objective of legal translation is for the target recipient to be provided as explicit, extensive and precise legal information in the target language as is contained in the source text, complemented (by the translator) with facts rendering the original information fully comprehensible in the different legal environment and culture. A dictionary which will help its users to produce legal texts in the target language should be founded upon a profound comparative legal and linguistic analysis that will (a) determine equivalents at the levels of vocabulary, syntax and genre, (b) select the appropriate lexicographic material to be included in the dictionary, and (c) create entries in a user-friendly manner.

Book Law Language and Translation

Download or read book Law Language and Translation written by Rosanna Masiola and published by Springer. This book was released on 2015-02-21 with total page 105 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a survey of how law, language and translation overlap with concepts, crimes and conflicts. It is a transdisciplinary survey exploring the dynamics of colonialism and the globalization of crime. Concepts and conflicts are used here to mean ‘conflicting interpretations’ engendering real conflicts. Beginning with theoretical issues and hermeneutics in chapter 2, the study moves on to definitions and applications in chapter 3, introducing cattle stealing as a comparative theme and global case study in chapter 4. Cattle stealing is also known in English as ‘rustling, duffing, raiding, stock theft, lifting and predatorial larceny.’ Crime and punishment are differently perceived depending on cultures and legal systems: ‘Captain Starlight’ was a legendary ‘duffer’; in India ‘lifting’ a sacred cow is a sacrilegious act. Following the globalization of crime, chapter 5 deals with human rights, ethnic cleansing and genocide. International treaties in translation set the scene for two world wars. Introducing ‘unequal treaties’ (e.g. Hong Kong), chapter 6 highlights disasters caused by treaties in translation. Cases feature American Indians (the ‘trail of broken treaties’), Maoris (Treaty of Waitangi) and East Africa (Treaty of Wuchale).

Download or read book English as a Legal Language written by Rossini and published by Martinus Nijhoff Publishers. This book was released on 2023-12-18 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: English as a Legal Language is a lawyer's plain language guide to English legal terminology. Anyone who finds it difficult to express legal terms in English simply looks under the general heading to find the relevant terms and their usage. This book can also be used to find explanations of words from a translating dictionary. Further, it is structured as a thesaurus, organized according to topic with an alphabetical index. More and more, lawyers need the English language. But attempts to convert the language to meet one's own purpose often result in misconceptions. English legal language has its roots in the Anglo-American legal tradition and the non-native speaking lawyer may have difficulty understanding a word choice in English without also seeing how it fits into legal thinking and relates to other words in the subject area as a whole. English as a Legal Language offers a comparative lexicon of US and UK legal systems, with references to European legal systems. Special features of this work include: - The vocabulary of an entire area of law in each section; - A verb section which provides guidance on substantives, adjectives, adverbs, phrases, usage, as well as sample sentences and clues about typical mistakes; and - An index which gives an alphabetical rendition of the topically ordered definitions - essential for words that have multiple definitions. All lawyers working in English, and especially continental European lawyers, will find this book indispensable in their practices. The book is also of prime interest to business people, accountants, translators, legal secretaries and students. It will enable all practitioners and academics to express complex ideas in English, to understand the intricacies of English as a legal language, and to avoid the potential mishaps, when language barriers prevent a true meeting of minds.

Book Essential Legal English in Context

Download or read book Essential Legal English in Context written by Karen M. Ross and published by NYU Press. This book was released on 2019-04-04 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: An essential handbook for international lawyers and students Focusing on vocabulary, Essential Legal English in Context introduces the US legal system and its terminology. Designed especially for foreign-trained lawyers and students whose first language is not English, the book is a must-read for those who want to expand their US legal vocabulary and basic understanding of US government. Ross uses a unique approach by selecting legal terms that arise solely within the context of the levels and branches of US government, including terminology related to current political issues such as partisanship. Inspired by her students’ questions over her years of teaching, she includes a vast collection of legal vocabulary, concepts, idioms, and phrasal verbs and unpacks concepts embedded in US case law, such as how the US constitutional separation of powers may affect a court’s interpretation of the law. The handbook differentiates basic terms in civil and criminal cases and compares terms that may seem similar because of close spellings but in fact have different meanings. For instance, what is the distinction between “taking the stand” and “taking a stand?” What is the difference between “treaties” and “treatises”? Featuring illustrations and hands-on exercises, Essential Legal English in Context is a valuable self-study resource for those who want to improve their legal English terminology before entering a US law school, studying US law or government, or working as a seconded attorney to a US law firm. Instructors can use the handbook in an introductory US legal English course.

Book Translators Law Dictionary

Download or read book Translators Law Dictionary written by Eric Engle and published by Eric Engle. This book was released on with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work presents the basic legal terminology used in the English language with equivalent terms from German, principally, and French secondarily: that is because the French term is often some cognate to English. The dictionary includes definitions in English for most, not all terms because sometimes a simple synonym suffices or the concept is obvious on sight to someone with at least the training of a paralegal. Latin and Italian terms are also occasionally represented as well. The Translator's Law Dictionary is useful to legal translators, comparative lawyers, and internationally active law firms as well as scholars of comparative and international law. While no multilingual law dictionary authored by one person in one lifetime could ever hope to be complete, this dictionary tries to present all the basics in current legal usage in the English language and equivalent concepts and terms from German and French. This dictionary has focused on the procedural and substantive facts of law, the indisipensable structural framework to any deeper discussion of the law. As well as the basics of law, this law has tried to present the essentials of commercial law: contracts, torts, corporations, and taxation. Obscure and ancient legal concepts and esoteric theoretical concepts are not discussed here, for such are rarely, if ever, used in practice. Rather, this works presents a well rounded, and reasonably complete exposition of the basic legal terminology of the world's greatest legal systems as part of the construction of the globalization of the rule of law. Thus, while practical and focused, the work also has some hopeful utility for visionaries, enabling jurists to anchor their concepts into new legal systems they will discover in the pages of this work.

Book Difficulties in Translating Legal Terms

Download or read book Difficulties in Translating Legal Terms written by Berenice Walther and published by GRIN Verlag. This book was released on 2014-02-03 with total page 116 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thesis (M.A.) from the year 2008 in the subject English Language and Literature Studies - Other, grade: 2, University of Münster (Arbeitsbereich Sprachwissenschaft), course: Dialogue Studies, language: English, abstract: In this paper, the major aspects of and essential developments in translation theory, including the ever-recurring question of what constitutes a good translation, will be explored and the particularity of legal translation will be discussed. In the translation of national law terms, many facets have to be kept in mind. For example, the mastering of the different languages poses problems as does the relation of legal texts to different and specific legal systems and cultures. The focus will then switch to legal language in particular. The opposition between word meaning of everyday language and the word meaning of languages for specific purposes will be clarified. Then, particular difficulties in legal language and translation with consideration of the different legal systems where these translations are used will be illustrated with respect to the nature of legal discourse, its dependence on the legal system and the presentation of possible ambiguities and their interpretation. The problem of a common legislation in the European Union is one of finding a legal terminology that is not influenced by its cultural environment – an entirely impossible enterprise.
