Book Broberg and Fenger on Preliminary References to the European Court of Justice

Download or read book Broberg and Fenger on Preliminary References to the European Court of Justice written by Morten Broberg and published by Oxford University Press. This book was released on 2021-03-25 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is structured to reflect the different questions that may arise in connection with a preliminary reference. It explains who can make a reference, what questions can be referred, and when can, when should, and when must a reference be made. Thereupon the book provides detailed guidance on the form and contents of the actual reference as well as the procedure, both before the referring court and the European Court of Justice. Finally, the preliminary ruling and its effects are explained together with the questions of cost and legal aid. Now in its third edition, this book has proved to be of considerable value to the legal practitioner faced with the subtleties of a preliminary reference - be it as judge or advocate. However, it is much more than an advance practitioners' guide. With backgrounds as both practitioners and academics, the two authors have produced a book that also caters for the needs of academics. The practical guidance is thus supplemented by the critical analysis of the Court of Justice's practice. This fully updated and revised edition of Broberg and Fenger on Preliminary References to the European Court of Justice provides a meticulous, yet easily accessible examination of all aspects of the preliminary reference procedure.

Book Directory of EU Case Law on the Preliminary Ruling Procedure

Download or read book Directory of EU Case Law on the Preliminary Ruling Procedure written by René Barents and published by Kluwer Law International B.V.. This book was released on 2009-01-01 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Article 234 EC ensures that a divergent application of the EC Treaty or of the statutes and acts of its institutions is not allowed in any Member State. Unsurprisingly, its pivotal importance has given rise to a huge number of ECJ judgments and orders - about 700 by the beginning of 2009. Very often, a practitioner needs to establish whether the preliminary ruling procedure called for by Article 234 EC is required in a particular case being pursued in a national court, and any relevant ECJ ruling or order must be located. Herein lies the great value of this book. Dr Barents' very useful volume sorts paragraphs of the 700 judgments and orders by subject, making it easy to establish the relevance of a particular Community court ruling to a particular national court proceeding. In this book paragraphs of the judgments and orders are presented in the form of extracts sorted by subject. The subject headings are arranged according to a hierarchical system, descending from such overarching concepts as scope and participation to such precise categories as the following: situations outside the scope of community law; bodies not considered to be courts or tribunals; arbitration; third persons; rights of participants; formulation of preliminary questions; presumption of relevance of a preliminary reference; violation of the obligation to refer; requirement of a pending dispute; interim measures; modification of preliminary questions; questions rejected by the submitting court; new elements presented during the preliminary procedure; questions lacking precision; retroactive effects of judgments. Paragraphs of judgments relating to more than one subject are included under each relevant heading, where necessary accompanied by cross references to other headings. Under each extract or summary, the judgments and orders are referred to by case number in ascending order. The articles of the EC Treaty are cited according to the new method of citation pursuant to the renumbering of the articles of that treaty brought about by the Treaty of Amsterdam. There is no doubt that the book's technique of presenting case law in the form of separate extracts and summaries arranged by topic and sub-topic improves the accessibility of the material. This very practical, time-saving feature will be greatly appreciated by practitioners throughout Europe. This is a reference every European lawyer will want to have on hand.

Book Effective Grading Practices for Secondary Teachers

Download or read book Effective Grading Practices for Secondary Teachers written by Dave Nagel and published by Corwin Press. This book was released on 2015-03-04 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: Enact innovative grading systems that more accurately describe student progress! This book challenges traditional grading practices and provides alternatives that can have direct impact on student success. By making subtle shifts toward standards based grading systems, schools can reduce unnecessary course failures, provide students and their families a more accurate picture of current progress, and increase opportunities for success. The author offers a range of grading reform strategies that are built from practical frameworks that are effective and simple to adapt. Among the many strengths of this book are: Practical application of existing research and evidence base for effective secondary grading reforms A framework for schools and districts to apply and adapt failure prevention strategies such as early failure detection, Amnesty Days, and meaningful stipulated second chance opportunities for students to reach mastery Functional strategies and actions for shifting toward standards-based (referenced) grading without entirely abandoning letter grades Countering resistance to change through a-clearly-articulated plan for conducting school-wide and classroom level action research around the effectiveness of new or adjusted grading practices "Informative and pragmatic, this book is spot on with analysis of this elephant in the room issue. Nagel uses both empathy and humor in getting to the heart of a process to generate real solutions while underscoring the ultimate need for teacher voice in any successful implementation. He provides ready-made strategies for real, impactful change. I′m left hopeful that feedback will rule the day!" —Bruce Potter, Superintendent Berkshire UFSD "Nagel offers an insightful and articulate voice to secondary improvement and alignment through grading practices. His tried and true methods through working with real districts provides a starting place and examples for others to follow. A must-read for anyone serious about ensuring student engagement through meaningful feedback." —Debra K. Howe, Superintendent Tri-Creek School Corporation ?
