Download or read book Japanese Law written by J. Mark Ramseyer and published by University of Chicago Press. This book was released on 2000-11-15 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this introduction to Japanese law, J. Mark Ramseyer and Minoru Nakazato combine an economic approach with a clear and often amusing account of the law itself to challenge commonly held ideas about the law. Arguing against such things as the assumption that Japanese law differs from law in the United States and the idea that law plays only a trivial role in Japan or is culturally determined, this book will be recognized as a major contribution to the understanding of Japanese law. "A compelling economic analysis. . . . This book remains one of the few concerning Japanese law that successfully brings to life the legal culture of Japan." —Bonnie L. Dixon, New York Law Journal

For analysis of the facts this volume excels. A well-crafted introduction describes current debate about human rights theory and practice, traces the development of human rights instruments, and discusses problems of implementation. Strongly recommended. Library Journal The bulk of the scholarly literature on human rights deals with international law and politics. In contrast, this volume offers nineteen case studies of national human rights practices. Although international factors cannot be ignored, most human rights violations are perpetrated by states against their own citizens; the principal causes of the respect for and violation of human rights lie in national social and political structures.
Download or read book Sokaiya written by Kenneth Szymkowiak and published by Routledge. This book was released on 2015-04-15 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sokaiya are extortionists who target Japanese corporations for payoffs. They threaten to reveal corporate secrets and scandals, usually at shareholder meetings. This book explores the curious but not unusual relationship that grows between executives and sokaiya, who also offer their services to protect the corporation from other sokaiya, thus becoming a necessary evil in the world of Japanese business. The book documents the history and development of sokaiya over the past 100 years since Japan first enacted a commercial code. It includes interviews with police, lawyers, corporate executives, as well as sokaiya and members of the yakuza (traditional Japanese gangsters).
Download or read book The Subversive Activities Prevention Law of Japan written by Cecil H. Uyehara and published by BRILL. This book was released on 2010 with total page 472 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Subversive Activities Prevention Law (SAPL) was the last major controversial law to be drafted at the end of the Allied Occupation of Japan (1945-1952) which was managed and controlled by General Headquarters (GHQ) under U.S. General MacArthur and was enacted into law after Japan had regained its formal independence in 1952. Soon after the Occupation began, prewar Japanese internal security laws were ordered abolished by the Occupation. Now that Japan would be re-gaining its independence in 1952, there was urgency to creating a new integrated national internal security law to fill the vacuum created by the Occupation, 1945-1952. The Subversive Activities Prevention Law was to be the centerpiece for maintaining internal security in the new independent Japan. It turned out to be an extremely controversial law that was vociferously opposed by the political opposition in and out of the Diet in light of the prewar history, surrounding how such internal security laws were implemented by the state security apparatus. The demonstrations in 1951-52 against the proposed law, organized by the labor unions, were the largest, loudest and most determined since the end of the war. This publication is the first analysis in English on how this law was drafted and debated, supported and opposed, using the 20+ drafts of the law, and the subsequent deliberations concerning the proposed law in the Houses of Representatives and Councillors. A short epilogue - since over 50 years have elapsed since the law was initially enacted in 1952 - analyzes the implementation of the law during these years. "The Subversive Activities Prevention Law of Japan, Its Creation, 1951-1952" will be of particular interest to those studying the Allied Occupation of Japan, the Japanese political and legislative process and its internal security laws.
