Book Brief Making and the Use of Law Books Classic Reprint

Download or read book Brief Making and the Use of Law Books Classic Reprint written by William M. Lile and published by Forgotten Books. This book was released on 2018-01-07 with total page 590 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Brief Making and the Use of Law Books The failure Of the law schools to turn out graduates better prepared for the practical work of the office or court-room is an old and ever recurring theme of complaint from bench and bar. The recent graduate himself, wrestling with his earliest practical problems, is especially prone to lay his troubles at the door of the law school. Without stopping to inquire in what other directions the law school has come short of its duty to the student, law teachers generally must concede that while a knowledge of law books and their use - in short, brief-making, in its broader sense is an essential professional acquirement, this field is yet, for the average law-school graduate, a vast waste of uncharted and unexplored territory. Following precedent, the teacher has been content to lay before the student, in the form of lectures, text-books or cases, or these combined, principles of the teacher's own choosing; but little or no necessity for sus taining or combating a particular proposition by written argu ment is encountered by the student while in the law school. The result has been that the student enters upon the practice. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book The Law of Agency Classic Reprint

Download or read book The Law of Agency Classic Reprint written by Gleason Leonard Archer and published by Forgotten Books. This book was released on 2018-02-04 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Agency It has long been the custom of law writers, follow ing perhaps the example of the early pioneers of the craft, to write text books for the enlightenment of practicing la/wyers. Within the past quarter century or so law writers have included in their hoped-for audience law students as well as lawyers. The result has not been as happy as might be desired, for law yers nowadays have little use for elementary text books of law - the great digests, encyclopedias, and many-volumed texts having almost completely sup planted the less ambitious work. The real situation is that the great majority of readers of such works are law students. But a book designed primarily for lawyers, and only as an afterthought for students, is not a successful students' book. A book for beginners should, we believe, be written with the needs of the beginner constantly in mind. It must be simple and concise - as happy in the choice of what to eliminate as what to retain. It must pre sent the fundamental principles clearly and vividly to the reader. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Lawyer's Reference Manual of Law Books and Citations The preparation of this work was begun when the idea first suggested itself, but the occupations of a busy life have delayed its completion. In 1876 my father, Richard Soule (author of A Dictionary of English Synonymes and other books of reference), came to my assistance, and had nearly prepared the manuscript for the printer when his death occurred in 1877. His aid was so valuable that the book would have been published in his name if he had lived to carry it through the press. Book The First Principles of Law Classic Reprint

Download or read book The First Principles of Law Classic Reprint written by Henry Taylor Terry and published by Forgotten Books. This book was released on 2018-01-31 with total page 708 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The First Principles of Law The aim of this book is to set out in as plain and simple a manner as possible, and' in what the author ventures to think 18 a somewhat more philosophical arrangement than the usually accepted one of Blackstone, the most general and elementary principles of the law. It was written primarily for the use of the author's students beginning the study of the law; but it is hoped that it may be of service to students of law elsewhere, as well as possibly to readers who without intending to become lawyers wish to get a knowledge in outline of the nature and methods of legal science. It is not designed to take the place of the laiger and more complete treatises with which students generally, begin the1r legal studies, but rather to be used in connec tion with them: and for this reason many subjects have been omitted, such as Agency, Partnership and the greater part of the Law of Persons, which, though 01 the greatest interest and importance in themselves, may still be looked upon as being, so to speak, detachable from the main fabric of legal principles and affording merely special applications of rules and principles which the student ought to understand before he comes to the study of those special branches. Book Elementary Law Classic Reprint

Download or read book Elementary Law Classic Reprint written by William C. Robinson and published by Forgotten Books. This book was released on 2018-01-23 with total page 814 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Elementary Law IN preparing this new edition of a work which, in one form or another, has been in use among law students for the past forty years, the author has kept constantly in mind the fact that the ordinary and legitimate purpose of such students is to qualify themselves to begin the practice of the law with credit to their profession, with safety to their clients, and with profit to themselves. The young practitioner is not expected to be a legal philosopher or historian or critic, but to be able to give sound advice upon those legal questions which arise in common social and domestic life, to transact customary legal business with prudence and sagacity, and to conduct to a just issue such liu'gated cases as are likely to be confided to his care. To fit him to discharge these duties he needs an accurate and fairly extensive knowledge of the general rules and doctrines which constitute the great body of the law; a special familiarity with those departments of the law which govern the commercial transactions of the present day; and a practical training in those forms and methods of procedure which it will be his daily duty to employ. Book Introduction to American Law Classic Reprint

Download or read book Introduction to American Law Classic Reprint written by Timothy Walker and published by Forgotten Books. This book was released on 2017-12-26 with total page 782 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Introduction to American Law But I have entitled this book, an Introduction to American Law, and I may be called upon to vindicate the propriety of this title. I confess then, that in some minor respects, it may not be equally adapted to all parts of the Union; but my excuse is, that without being ten times as large as it is, 'it could not have been made so. If I had possessed the knowledge, I could not, within any reasonable compass, have referred to the local law of twenty-six different states; and yet local references were occasionally necessary, in order to exhibit an entire system. I was compelled, therefore, in such cases, to make choice of some particular state; and I naturally selected that state in which the lectures were read. But these local references, in an out line so general as this, are not so frequent as to detract materially from the general adaptation of the book, to students in other states; and in case of diversity, the necessary corrections can be easily made. At all events, the diversity is less between the different states, than between any one state and England; and therefore something is cer tainly gained even on the score of general adaptation. And here let me anticipate an objection of another sort. It may be said, that in attempting to teach what the law is, I have dwelt too much upon what I think it should be; or, in other words, that in a work professedly didactic, I have speculated too much upon projects of reform. To this objection I have two answers. In the first place, I have never undertaken to show what the law ought to be, without first stating what it is. While therefore the primary end of instruo tion is obtained, the mind of the student is at the same time excited to compare, examine and discuss the principles in question; and thus impress them the more deeply upon his memory. And in the second place, if the suggestions I have ventured to make be sound, they can not be made too early, because bad laws are the very worst of bad things; and if these suggestions be not sound, they can do no harm, because the antidote accompanies the bane; nay the provision com plained of will inspire increased confidence in the mind of the student from having been unsuccessfully assailed. But I cannot help believing that many of the proposed alterations would be decided improvements. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. The student during his earlier efforts seems to have some difficulty in learning where and how to find the law, and to have much greater diffi culty in attaining and keeping the legal point of View. Book Conflict of Laws Classic Reprint

Download or read book Conflict of Laws Classic Reprint written by John P. Tiernan and published by Forgotten Books. This book was released on 2017-10-11 with total page 136 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Conflict of Laws There are three general systems of legal instruction in use in American Law Schools - the lecture, the case, and the text method. Regardless of the relative superiority of one to the others, the author is convinced, after seven years teaching experience, that no one of these methods alone is adequate to sound, thorough instruction in the law. In his presentation of this difficult subject in the class-room, he has produced satisfactory results only by a combination of text, cases, and lecture in proper pro portion. The value of a text in stating the principles of the 1a7 in brief form can not be denied. The necessity of reading leading decisions that support and apply those principles is indisputable. And finally, there is the general discussion in class; the Instructor When neces sary, expounding the subject, imparting the benefits of his knowledge and experience and observation, thereby arousing and sustaining interest in the work; these are the things that elevate instruction from the mechanical to the intellectual. In presenting this text therefore, the author makes no defense. He has embodied the fundamentals of the sub jeot in the text in simple form. He has scrupulously selected the leading decisions and included them in the notes, Where they are identified by large conspicuous cita tion. Finally, instead of merely stating the law, he has by clear simple language explained it, so as to reproduce, as far as possible, the full value of the class instruction. It is this very feature, it is believed, that Will commend it for Law School purposes to Instructor and class alike. Book An Illustrated Treatise on the Law of Evidence Classic Reprint

Download or read book An Illustrated Treatise on the Law of Evidence Classic Reprint written by T. Hughes and published by . This book was released on 2015-07-06 with total page 740 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from An Illustrated Treatise on the Law of Evidence To the trial lawyer no subject in the law curriculum is of more importance than Evidence. In this branch of the law questions arise very frequently, and usually they must be answered on the spur of the moment. It is essential, therefore, that the lawyer have at his tongue's end the rules and their exceptions. Moreover, since the test of the keen lawyer is his ability to make fine legal discriminations, it is also essential that he possess a well disciplined mind in the art of applying them. In the present volume an attempt has been made to state pointedly and systematically these various rules and exceptions; and since the law is an applied science, numerous illustrations have been given to elucidate their application. Every topic is fully illustrated; every illustration is founded upon an actual case, and for each case the citation is given. With the view of securing compactness, these illustrations, instead of being scattered throughout the book, have been made a distinct part of it and placed after the text proper. This plan, it is believed, will meet with general approval. As an aid in developing ability to make fine legal discriminations the reader is earnestly advised to study carefully these illustrations and where practicable to do so to read the cases upon which they depend. In the preparation of this volume it has been the aim of the author to produce a text-book which will prove serviceable when used independently of any other work; but believing that it will also be found serviceable in connection with the study of Thayer's "Cases on Evidence" the general arrangement of topics in that work has been followed. Book excerpt: Excerpt from Law of Evidence The philosophy of the present age is founded on a more charitable view of human nature than was indulged in by the prejudices of our ancestors, whose rules of action were often framed in the darker ages of the human race, and by narrow minded and bigoted persons. If, says Mr. Taylor, the rules of exclusion, recognized till lately by the English law, had been really founded, as they purported to be, on public experience, they would have furnished a omost revolting pic ture of the ignorance and depravity of human nature. In rejecting the evidence of parties to the record, and other interested witnesses, the law acted on the presumption, not only that such persons, sooner than make a statement which might prejudice themselves, would commit deliberate perjury, but that, if they did so, juries would be incapable of detect ing the falsehood. A more unfounded calumny upon the veracity of Witnesses and the intelligence of juries cannot well be imagined.
