Book excerpt: There is a highly significant and under-considered intersection and interaction between migration law and labour law. Labour lawyers have tended to regard migration law as generally speaking outside their purview, and migration lawyers have somewhat similarly tended to neglect labour law. The culmination of a collaborative project on 'Migrants at Work' funded by the John Fell Fund, the Society of Legal Scholars, and the Research Centre at St John's College, Oxford, this volume brings together distinguished legal and migration scholars to examine the impact of migration law on labour rights and how the regulation of migration increasingly impacts upon employment and labour relations. Examining and clarifying the interactions between migration, migration law, and labour law, contributors to the volume identify the many ways that migration law, as currently designed, divides the objectives of labour law, privileging concerns about the labour supply and demand over worker-protective concerns. In addition, migration law creates particular forms of status, which affect employment relations, thereby dividing the subjects of labour law. Chapters cover the labour laws of the UK, Australia, Ireland, Israel, Italy, Germany, Sweden, and the US. References are also made to discrete practices in Brazil, France, Greece, New Zealand, Mexico, Poland, and South Africa. These countries all host migrants and have developed systems of migration law reflecting very different trajectories. Some are traditional countries of immigration and settlement migration, while others have traditionally been countries of emigration but now import many workers. There are, nonetheless, common features in their immigration law which have a profound impact on labour law, for instance in their shared contemporary shift to using temporary labour migration programmes. Further chapters examine EU and international law on migration, labour rights, human rights, and human trafficking and smuggling, developing cross-jurisdictional and multi-level perspectives. Written by leading scholars of labour law, migration law, and migration studies, this book provides a diverse and multidisciplinary approach to this field of legal interaction, of interest to academics, policymakers, legal practitioners, trade unions, and migrants' groups alike.

The analysis builds on the understanding of socio-cultural, institutional and legal factors as “barriers” or “enablers”; elements that may facilitate or obstruct the integration processes. The book examines the two dimensions of integration being access to the labour market (which, translated into a rights language means the right to work) with its corollaries (recognition of qualifications, vocational training, etc.), and non-discriminatory working conditions (which, translated into a rights language means right to both formal and substantial equality) and its corollaries of benefits and duties deriving from joining the labour market. It thereby offers a novel approach to labour market integration and migration/asylum issues given its focus on legal aspects, which includes most recent policy changes and legal decisions (including litigation cases). The robust, evidence-based and comparative research illustrated in the book provides academics and students, but also practitioners and policy makers, with up to date knowledge that will likely impact positively on policy changes needed to better address integration conundrums.

Book excerpt: Guaranteeing third country national workers robust equal treatment with regard to working conditions and pay is a crucial condition for avoiding social dumping, exploitation, and other reasons for regime shopping within the EU. However, Member States are still reluctant to compromise control of their borders and their labour markets. The EU legislation adopted is, as a result, fragmented and full of solutions that give Member States an extensive margin of room for manoeuvre. In this book six distinguished European labour law academics discuss how three EU directives on labour migration – the Single Permit Directive, the Blue Card Directive, and the Directive on Seasonal Employment – interact with the labour migration systems of France, Germany, Italy, Poland, and Sweden – five countries with very different characteristics and approaches to implementation. Concrete issues dealt with in each country include the following: – conditions for granting work permits; - reasons for withdrawing a work permit; - how long a migrant worker can stay; - whether a migrant worker can bring his or her family; - employment and labour rights of migrant workers; - migrant workers' access to social rights; - how a migrant worker may enforce rights; - sanctions for violations of applicable provisions; and - potential for permanent status for a migrant worker. For each of these issues the authors analyse to what extent national legislators have been ready to adapt their national systems in order to fulfill the aims of the EU directives. They also identify unintended, or at least not explicit, effects of the implementation process. The authors clearly reveal whether the ambitions of the EU when initiating this process can be detected in the implementation process, and how implementation of the three directives have changed and could change national law on these issues. As the first in-depth analysis of how the intersection of migration and labour law and their impact on labour and employment relations play out in the EU context this book brings important insights to the growing literature in this field. The analysis will be of particular interest to national legislators, but is also sure to be warmly welcomed by academics and practitioners in fields related to labour and employment and migration.

From a formal point of view the right to family reunification, enjoys international and national protection. This book examines the protection of family life and family reunification within the framework of international conventions on human rights, family reunification and the protection of family life in the area of justice, the rights of family members of European citizens in the EU legislation and the case law; the rules set by the Directives 2004/38/EC and 2003/86/EC, the relationship between EU legislation on family reunification and the respect of national rules governing the entry and residence of migrants. An important part of this work is dedicated to the right of family reunification in the national law, namely to protect the family unit in Italy in accordance with the Consolidated immigration no. 296/98.

Engaging with the politics of crowding thus entails a direct and pertinent engagement with the modern state’s politics of criminal justice and social control. Worldwide, over the last decades, a growing number of jurisdictions have prison systems operating above or to the limit of their capacity, yet little attention has been paid to these elements in the analysis of prison politics and day-to-day functions. By exploring the crowding issue, this book offers an original and interesting insight into the politics and dynamics characterising contemporary prison systems. The hypothesis of this book is that the politics of prison crowding have become the template for the daily administration of the prison system, which incorporates not just policy and rules but day-to-day functions and practices regulating life behind bars. Through interviews in modern Italian prisons, the book brings to light a radical redefinition of a carceral system that harshens the delivery of punishment while justifying this exacerbation of pain by adding new bureaucratic logic to the administration of the penal system within a narrative of compliance to human rights standards. Farris examines the demands for women's rights from an unlikely collection of right-wing nationalist political parties, neoliberals, and some feminist theorists and policy makers. Focusing on contemporary France, Italy, and the Netherlands, Farris labels this exploitation and co-optation of feminist themes by anti-Islam and xenophobic campaigns as “femonationalism.” She shows that by characterizing Muslim males as dangerous to western societies and as oppressors of women, and by emphasizing the need to rescue Muslim and migrant women, these groups use gender equality to justify their racist rhetoric and policies. This practice also serves an economic function. Farris analyzes how neoliberal civic integration policies and feminist groups funnel Muslim and non-western migrant women into the segregating domestic and caregiving industries, all the while claiming to promote their emancipation. In the Name of Women's Rights documents the links between racism, feminism, and the ways in which non-western women are instrumentalized for a variety of political and economic purposes.

The present volume introduces the reader to the traditions of migration research in twelve different countries: the more traditional immigration countries of Canada and Australia, four European countries with decades of experience (United Kingdom, Germany, Austria, Netherlands), countries newer to immigration such as Italy, Poland and Japan, and finally the postcolonial countries of India, Malaysia and Nigeria. Through this comparative approach this volume presents a new approach to understanding the different research traditions. The reader is confronted with the various ways in which emigrants are included or excluded from society, thereby gaining an understanding of the existing intellectual discourses as well as learning to qualify them in the light of other solutions and traditions.
