Book The Law of the Baltic States

Download or read book The Law of the Baltic States written by Tanel Kerikmäe and published by Springer. This book was released on 2017-04-05 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to present the law of the Baltic States in one comprehensive and coherent volume in English. The Baltic States region, which was incorporated by the Soviet Union for 50 years and now is the only such territory in the EU, continues to be characterized by a number of unique traits, problems and developmental trends. This book addresses these facets of law – the status quo, problems and trends – by adopting a comparative perspective structure for all three Baltic States (divided into three main parts – Estonia, Latvia and Lithuania). Each of these parts examines similar core aspects: General Frameworks, Public Law, and Private Law. Taking into account the peculiarities of each country, the individual chapters provide analyses of principles, problems and developments in specific legal branches. The authors of the book are recognized academics and professionals in the field of law. Taken together, their contributions offer a valuable tool and resource for anyone interested in the law of the Baltic States: students, legal practitioners, scholars, administrators, etc.

Book Russia and Latvia

  • Author : Andis Kudors
  • Publisher : Taylor & Francis
  • Release : 2023-11-17
  • ISBN : 1003802346
  • Pages : 203 pages

Download or read book Russia and Latvia written by Andis Kudors and published by Taylor & Francis. This book was released on 2023-11-17 with total page 203 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores Russia’s relations with Latvia, arguing that Latvia, with a higher proportion of Russian speakers than other Baltic states, is especially vulnerable to Russia’s “sharp power”. The book highlights how authoritarian and totalitarian regimes are unable to exercise soft power based on the attractiveness of the country's culture and values, which would help them gain the favour of the audience of the target countries, but instead, as in the case of Russia, use public diplomacy, compatriot policy, media policy, propaganda, and disinformation to produce a destructive effect, distorting the democracies of target countries and increasing national security risks. The book provides in-depth detail on how Russia is making use of this “sharp power” in Latvia, examines the consequences and assesses the dangers for the future.

Book The Soft Power of the Russian Language

Download or read book The Soft Power of the Russian Language written by Arto Mustajoki and published by Routledge. This book was released on 2019-06-12 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: Exploring Russian as a pluricentric language, this book provides a panoramic view of its use within and outside the nation and discusses the connections between language, politics, ideologies, and cultural contacts. Russian is widely used across the former Soviet republics and in the diaspora, but speakers outside Russia deviate from the metropolis in their use of the language and their attitudes towards it. Using country case studies from across the former Soviet Union and beyond, the contributors analyze the unifying role of the Russian language for developing transnational connections and show its value in the knowledge economy. They demonstrate that centrifugal developments of Russian and its pluricentricity are grounded in the language and education policies of their host countries, as well as the goals and functions of cultural institutions, such as schools, media, travel agencies, and others created by émigrés for their co-ethnics. This book also reveals the tensions between Russia’s attempts to homogenize the 'Russian world' and the divergence of regional versions of Russian reflecting cultural hybridity of the diaspora. Interdisciplinary in its approach, this book will prove useful to researchers of Russian and post-Soviet politics, Russian studies, Russian language and culture, linguistics, and immigration studies. Those studying multilingualism and heritage language teaching may also find it interesting.

Book The Max Planck Handbooks in European Public Law

Download or read book The Max Planck Handbooks in European Public Law written by Armin von Bogdandy and published by Oxford University Press. This book was released on 2020-03-12 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The Max Planck Handbooks in European Public Law describe and analyse public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, the series aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series began this enterprise with an appraisal of the evolution of the state and its administration, offering both cross-cutting contributions and specific country reports. The third volume (the second in chronological terms) continues this approach with an in-depth appraisal of constitutional adjudication in various and diverse European countries. Fourteen country reports and two cross-cutting contributions investigate the antecedents, foundations, organization, procedure, and outlook of constitutional adjudicators throughout the Continent. They include countries with powerful constitutional courts, jurisdictions with traditional supreme courts, and states with small institutions and limited ex ante review. In keeping with the focus on a diverse but unified legal space, each report also details how its institution fits into the broader association of constitutional courts that, through dialogue and conflict, brings to fruition the European legal space. Together, the chapters of this volume provide a strong and diverse foundation for this dialogue to flourish.

Book excerpt: The book comprises contemporary legal theory pertaining to Democratic States based on the Rule of Law from the perspective of general principles of law. It explains in detail, theoretically and based on the specific case law, the phenomenon of general principles of law – as a source of law and directly applicable legal norms. It is a work of legal theory, legal philosophy, and legal method, but it will also assist scholars and practitioners in the transitional justice field as it shows how this theory of general principles of law has assisted Latvia to move away from the socialist legal tradition.

Book The Effectiveness of the K bler Liability in National Courts

Download or read book The Effectiveness of the K bler Liability in National Courts written by Zsófia Varga and published by Bloomsbury Publishing. This book was released on 2020-10-15 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the last 15 years, Köbler liability has resulted in the allocation of damages on only five occasions. Why is that? And what are the practical implications of the Köbler judgment in the Member States? This book offers a unique analysis of the principle – not from the usual EU-focused point of view but from the view of the practical Member State – and thus follows the track set by earlier books in the 'EU Law in the Member States' series. It thoroughly examines the national jurisprudential and legislative acceptation of the state liability principle and explores the existence of alternative remedies available in the Member States in case of such breaches. The conclusions, based on a systematic assessment of 300 national judgments from the 28 Member States, lead to a reconsideration of the role of the Köbler doctrine in the system of judicial remedies against violation of EU law by national supreme courts. After the pronouncement of the ECJ judgment in Köbler, legal scholars and practitioners have forecast the eradication of the principle of res judicata and the endangering of judicial independence. The judgment caused a lot of ink to flow; according to the ECJ's records, at least 100 studies are directly devoted to the analysis of this decision. This book is, however, the first to offer a comprehensive analysis on the genuine life of the Köbler liability in the Member States.
