The book is structured into three sections, each of which corresponds to a different body of work on Latinos. Section One explores the historical dynamics and influence of ethnicity in law enforcement, and focuses on how ethnicity impacts policing field practices, such as traffic stops, use of force, and the subsequent actions that police departments have employed to alleviate these problems. A detailed examination of critical issues facing Latino defendants seeks to better understand the law enforcement process. The history of immigration laws as it pertains to Mexicans and Latinos explains how Mexicans have been excluded from the United States through anti-immigrant legislation. Book excerpt: In June 1943, the city of Los Angeles was wrenched apart by the worst rioting it had seen to that point in the twentieth century. Incited by sensational newspaper stories and the growing public hysteria over allegations of widespread Mexican American juvenile crime, scores of American servicemen, joined by civilians and even police officers, roamed the streets of the city in search of young Mexican American men and boys wearing a distinctive style of dress called a Zoot Suit. Once found, the Zoot Suiters were stripped of their clothes, beaten, and left in the street. Over 600 Mexican American youths were arrested. The riots threw a harsh light upon the deteriorating relationship between the Los Angeles Mexican American community and the Los Angeles Police Department in the 1940s. In this study, Edward J. Escobar examines the history of the relationship between the Los Angeles Police Department and the Mexican American community from the turn of the century to the era of the Zoot Suit Riots. Escobar shows the changes in the way police viewed Mexican Americans, increasingly characterizing them as a criminal element, and the corresponding assumption on the part of Mexican Americans that the police were a threat to their community. The broader implications of this relationship are, as Escobar demonstrates, the significance of the role of the police in suppressing labor unrest, the growing connection between ideas about race and criminality, changing public perceptions about Mexican Americans, and the rise of Mexican American political activism.

Originating from the Caribbean, Spain, Central and South America, and Mexico, they have unique justice concerns. The ethnic group includes U.S. citizens, authorized resident aliens, and undocumented aliens, a group that has been a constant partner in the Latino legal landscape for over a century. This book addresses the development and rapid growth of the Latino population in the United States and how race-based discrimination, hate crimes, and other prejudicial attitudes, some of which have been codified via public policy, have grown in response. Salinas explores the degrading practice of racial profiling, an approach used by both federal and state law enforcement agents; the abuse in immigration enforcement; and the use of deadly force against immigrants. The author also discusses the barriers Latinos encounter as they wend their way through the court system. While all minorities face the barrier of racially based jury strikes, bilingual Latinos deal with additional concerns, since limited-English-proficient defendants depend on interpreters to understand the trial process. As a nation rich in ethnic and racial backgrounds, the United States, Salinas argues, should better strive to serve its principles of justice.

Book excerpt: This report summarizes a 3-year monitoring effort by the staff of the Western Regional Office of the United States Commission on Civil Rights concerning police-community relations in San Jose, Calif. In 1976, San Jose minority community representatives alleged that law officers used abusive and threatening language, threats of arrest in individuals complained, and deadly force. All too often, they alleged, the victims were the city's minorities. The report describes the background of the problem and community perceptions and the police department response during the period of change between 1976 and 1979. The civil rights staff, which interviewed over 120 persons, including city and law enforcement officials, clergy, public and private agency representatives, and minority community representatives, found that the level of fear, mistrust, and hostility toward the police in San Jose in 1979 did not seem to approximate that of 1976. The staff also found that there was a police department administrative emphasis on courtesy and professional service, a recognizable and definable police-community relations program, and a decrease in the number of officer-involved shootings. Although minority community relations with police improved, incidents of abuse were still reported. In addition, interviews revealed an unresolved conflict within the police department over whether the department should emphasize law enforcement or service. Footnotes and tabular data are included. Appendixes contain letters from the president and vice-president of the San Jose Peace Officers' Association.
