Book excerpt: El presente estudio pretende ofrecer un análisis y sus consecuentes reflexiones sobre los límites que el ordenamiento jurídico internacional ha establecido a las políticas migratorias de los Estados desde la perspectiva de la tutela jurídica internacional de los derechos y libertades de los inmigrantes. Se pretende a este respecto poner de manifiesto la importancia de la consecución del equilibrio exigido por el Derecho internacional público entre el interés del Estado en desarrollar su propia política migratoria y el respeto de las obligaciones jurídicas internacionales relativas a los derechos y libertades de los inmigrantes en el contexto de una política jurídica universal marcada por una progresiva tendencia a la equiparación en materia de derechos y libertades entre nacionales y extranjeros. Los problemas de índole práctica que ello plantea se evidencian si, a la luz de las actuales dinámicas del fenómeno de la inmigración, se examina esta cuestión desde una aproximación a la política migratoria de España —y de la política jurídica que revela el ordenamiento jurídico español—, así como de las perspectivas de evolución de la misma conforme a las directrices presentes y de futuro de la política comunitaria de inmigración que se define a partir del Título IV del Tratado de la Comunidad Europea.

The book focuses on the legal protection and promotion of FoRB in Europe because, in this context, exercising this right goes beyond a mere internal positioning in terms of legislation; rather, it is influenced by international and supranational case law, as well as the promotional activities of selected non-state subjects of international law. The content is divided into three sections: Part I on the European Convention of Human Rights, Part II on the EU, and Part III on other international actors. The first two Parts examine FoRB in its systematic aspects and “day-to-day” aspects. In contrast, the third Part highlights the promotional activities carried out by the Holy See, the ILO, the Council of Europe (“beyond the Strasbourg Court”), and the OSCE to promote, recommend or otherwise support it. Overall, the volume highlights how the exercise of FoRB can be ensured via international and supranational legal protection (both normative and judicial) and via promotional activities aimed at encouraging and helping states guarantee tolerance and pluralism in their national legislation. El mito esconde importantes dosis de xenofobia y de criminalización de personas que simplemente han atravesado irregularmente una frontera o se hallan con una documentación caducada.El respeto de los Derechos Humanos de las personas en situación irregular no siempre se produce en nuestros democráticos Estados de Derecho{ en ellos surge con demasiada frecuencia el cinismo del doble o triple lenguaje. El respeto efectivo de los Derechos Humanos (universales, indivisibles, interdependientes, inalienables e irrenunciables) interesa a todos y a todas. Cuando algún grupo de personas sufre su violación, otras personas (en esta hipótesis, muchos ciudadanos de la Unión) no se dan cuenta de que se cuestiona, sufre y peligra la misma esencia de la democracia.
