Todo ello desde una perspectiva eminentemente práctica, pues a los exhaustivos comentarios doctrinales de cada materia tratada se acompañan, además de un abundante apéndice jurisprudencial sistematizado y pormenorizado (con resoluciones de los Tribunales Constitucional y Supremo, así como de las Audiencias Provinciales y Juzgados), los modelos o formularios de los principales escritos de los litigantes y de las resoluciones judiciales pertinentes en cada caso. Los primeros Capítulos se dedican a la Parte General de las Medidas Cautelares, examinando desde sus presupuestos (fumus boni iuris, periculum in mora, caución...) y características (jurisdiccionalidad, proporcionalidad...), hasta la tramitación general que la Ley dispone en orden a la solicitud, oposición y resolución de una medida cautelar, distinguiendo, además, las especialidades habidas en las medidas preprocesales y en las que se instan con posterioridad a la presentación de la demanda. Mientras que en el resto de la obra se analizan con detalle, y una a una, todas las medidas cautelares admisibles en nuestro ordenamiento procesal civil (embargo, anotaciones preventivas, suspensión de acuerdos sociales, intervención y depósito de bienes...). En esta segunda edición se ha revisado y actualizado completamente la obra, y se ha ampliado muy considerablemente el apartado de jurisprudencia, pues el tiempo transcurrido desde la entrada en vigor de la nueva LEC ha permitido ya incorporar todas las resoluciones judiciales que interpretan la vigente regulación en materia cautelar. Son autores de la misma el Catedrático de Derecho Procesal y ex-Letrado del Tribunal Constitucional, Dr. José Garberí Llobregat (autor de diversos comentarios generales y monográficos sobre la nueva LEC), y los Magistrados y también profesores de Derecho Procesal José Ma Torres Fernández de Sevilla y Luís Casero Linares.

Book excerpt: Greater efficiency in civil dispute resolution is very much dependent on organized but fair fact-finding. Under European law, however, no clear-cut categorisation of means of evidence exists as yet, and significantly diverging interpretations persist of what is considered 'evidence' in the sense of the foundational Council Regulation (EC) No. 1206/2001 (EER). The EER fails to provide comprehensive rules for many other aspects of evidence taking, pointing instead to national legislation for solutions. As long as evidentiary rules remain different from country to country, there is an inherent risk of conflict of laws between different systems in the course of cooperation between courts in cross-border matters, leading to mistrust amongst judiciary and other participants in the proceedings. Focusing on national rules, and using a comparative method which takes into consideration legal experiences from all legal circles in the EU, this book explains and analyses how the law of evidence works in Europe today. The authors draw on the vast base of relevant information collected in twenty-seven Member States by national reporters.
