En el Norte se trata de conservar y hacer evolucionar los derechos adquiridos, susceptibles, a menudo en nuestra época, de reestrucutraciones. En el Sur, en donde en muchas partes son aún derechos a conquistar en el marco de las democracias más o menos sólidas y muchas veces únicamente formales, donde se da una ausencia de gobernabilidad , una presencia de las guerras y un foso entre los grupos sociales muy acusado. Frente a estas amenazas que una globalización salvaje proyecta sobre los derechos es imprescindible repensar las responsabilidades del Estado en su implantación y reconocer la necesidad de la legitimidad de una sociedad civil activa, cívica y solidaria que los haga exigibles con toda urgencia.
