Book excerpt: En las dos últimas décadas del siglo XX, y continuando una tradición anterior, se promulgaron distintas leyes sustantivas especiales, entre otras, las relativas a propiedad industrial (Ley 11/1986, de Patentes, y Ley 32/1988, de Marcas) y a competencia desleal (Ley 3/1991), las cuales, junto a normas sustantivas, introdujeron otras de naturaleza evidentemente procesal. Uno de los objetivos de la nueva Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil, es la consecución de una mayor simplificación procedimental en un intento de reducir las especialidades subsistentes en Derecho procesal civil, con el ánimo de mantener las que sean estrictamente necesarias. Sin embargo, ni todas las especialidades han corrido igual suerte, ni para la conservación de todas las especialidades subsistentes se ha utilizado la misma técnica, situación que suscitará numerosos problemas hermenéuticos que se apuntan en este trabajo. Con todo, este complejo entramado normativo se enriquece con la reciente Ley 17/2001, de 7 de diciembre, de Marcas, la cual, no obstante su carácter continuista respecto de su precedente en algunos aspectos, resulta realmente novedosa en otros. En consecuencia, en el presente estudio se efectúa una aproximación a la incidencia y problemática que la LEC de 2000 y la Ley de Marcas de 2001 pueden suscitar con relación al proceso civil en materia de competencia desleal y propiedad industrial, procediéndose a un análisis de la nueva normativa a la luz de las aportaciones doctrinales y jurisprudenciales realizadas sobre la legislación anterior, en la medida en que se consideren aprovechables.
