Available in PDF, EPUB and Kindle. Book excerpt: In this comprehensive comparative study, Ronán Feehily analyses the legal and regulatory issues surrounding international commercial mediation and discusses their implications in a range of settings. While existing literature tends to cover mediation in general, Feehily places the commercial mediation process in its legal and regulatory context, offering an original contribution to the field. The book identifies the controversies that arise from the mediation process across numerous jurisdictions and discusses them in detail. Comparing the mediation process in Europe, North America and Australia, as well as other common, civil and 'mixed' jurisdictions, Feehily demonstrates where systemic differences are transcended and where they are significant. Organised systematically and written in an accessible style, Feehily offers an international, holistic guide to the commercial mediation process.

Book Transforming the Workforce for Children Birth Through Age 8

Download or read book Transforming the Workforce for Children Birth Through Age 8 written by National Research Council and published by National Academies Press. This book was released on 2015-07-23 with total page 587 pages. Available in PDF, EPUB and Kindle. Book excerpt: Children are already learning at birth, and they develop and learn at a rapid pace in their early years. This provides a critical foundation for lifelong progress, and the adults who provide for the care and the education of young children bear a great responsibility for their health, development, and learning. Despite the fact that they share the same objective - to nurture young children and secure their future success - the various practitioners who contribute to the care and the education of children from birth through age 8 are not acknowledged as a workforce unified by the common knowledge and competencies needed to do their jobs well. Transforming the Workforce for Children Birth Through Age 8 explores the science of child development, particularly looking at implications for the professionals who work with children. This report examines the current capacities and practices of the workforce, the settings in which they work, the policies and infrastructure that set qualifications and provide professional learning, and the government agencies and other funders who support and oversee these systems. This book then makes recommendations to improve the quality of professional practice and the practice environment for care and education professionals. These detailed recommendations create a blueprint for action that builds on a unifying foundation of child development and early learning, shared knowledge and competencies for care and education professionals, and principles for effective professional learning. Young children thrive and learn best when they have secure, positive relationships with adults who are knowledgeable about how to support their development and learning and are responsive to their individual progress. Transforming the Workforce for Children Birth Through Age 8 offers guidance on system changes to improve the quality of professional practice, specific actions to improve professional learning systems and workforce development, and research to continue to build the knowledge base in ways that will directly advance and inform future actions. The recommendations of this book provide an opportunity to improve the quality of the care and the education that children receive, and ultimately improve outcomes for children.

Book Beginning Writers in the Zone of Proximal Development

Download or read book Beginning Writers in the Zone of Proximal Development written by Elizabeth Petrick-Steward and published by Routledge. This book was released on 2012-10-12 with total page 280 pages. Available in PDF, EPUB and Kindle. Book excerpt: How do young children bridge the gap between "writing" a story with pictures and writing with words? How children learn to use written words to tell a story is a topic important to both cognitive development and early literacy instruction. Using the theoretical framework developed by Vygotsky, the behavior of a group of prekindergarten children as they author two consecutive pieces of writing is analyzed. The children tell their stories at first with spoken words and pictures. As they discuss their work-in-progress in public conferences, they discover how to build on and combine existing skills to produce a new skill -- telling stories with written words. Current descriptive and theoretical perspectives on beginning writing are presented in this volume, with a particular focus on Vygotsky's concept of the zone of proximal development, a period of sensitivity in which learning advances. The proposed mechanism of change is verbal mediation -- talk among peers and teachers as they discuss work-in-progress -- which moves the children through the zone of proximal development. An open, whole-language approach to literacy instruction makes the classroom in this book an ideal arena in which to observe verbal mediation in operation. Children are free to question, criticize and argue; and in the process they collectively advance their developing ability to use written language. The work is unique in that the rich and comprehensive data record is reproduced in its entirety. More than 400 illustrations of the children's products -- two "books" apiece, pictured before and after the children's revisions -- are included, along with transcripts of the conferences about each of the pages, permitting direct observation of the effects of verbal mediation. This dynamic study documents change during a period of time when specific learning is occurring, and provides strong support for the value and power of Vygotsky's theoretical framework.

Book Medical Malpractice Litigation

Download or read book Medical Malpractice Litigation written by Bernard S. Black and published by Cato Institute. This book was released on 2021-04-27 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Drawing on an unusually rich trove of data, the authors have refuted more politically convenient myths in one book than most academics do in a lifetime." —Nicholas Bagley, professor of law, University of Michigan Law School "Synthesizing decades of their own and others’ research on medical liability, the authors unravel what we know and don’t know about our medical malpractice system, why neither patients nor doctors are being rightly served, and what economics can teach us about the path forward." —Anupam B. Jena, Harvard Medical School Over the past 50 years, the United States experienced three major medical malpractice crises, each marked by dramatic increases in the cost of malpractice liability insurance. These crises fostered a vigorous politicized debate about the causes of the premium spikes, and the impact on access to care and defensive medicine. State legislatures responded to the premium spikes by enacting damages caps on non-economic, punitive, or total damages and Congress has periodically debated the merits of a federal cap on damages. However, the intense political debate has been marked by a shortage of evidence, as well as misstatements and overclaiming. The public is confused about answers to some basic questions. What caused the premium spikes? What effect did tort reform actually have? Did tort reform reduce frivolous litigation? Did tort reform actually improve access to health care or reduce defensive medicine? Both sides in the debate have strong opinions about these matters, but their positions are mostly talking points or are based on anecdotes. Medical Malpractice Litigation provides factual answers to these and other questions about the performance of the med mal system. The authors, all experts in the field and from across the political spectrum, provide an accessible, fact-based response to the questions ordinary Americans and policymakers have about the performance of the med mal litigation system.

Book Guide for Establishing and Maintaining Pest Free Areas

Download or read book Guide for Establishing and Maintaining Pest Free Areas written by Food and Agriculture Organization of the United Nations and published by Food & Agriculture Org.. This book was released on 2019-10-15 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of the Guide is to support national plant protection organizations (NPPOs) who wish to establish and maintain pest free areas (PFA) including places and/or production sites (PFPP and PFPS) as well as areas of low pest prevalence (ALPP). To facilitate an understanding of the processes to establish and maintain PFAs and ALPPs, a diagram in the form of a decision tree was constructed that identifies and outlines five general phases of programme development as follows: initiation, feasibility, establishment, maintenance, and market access phases. The guide is then divided into corresponding sections that describe what the key elements of each phase are, why these elements are important, what some of the common challenges and pitfalls are, and factors that may influence the success of the different phases such as budget stability, public outreach, availability of good survey and control tools, and open engagement with stakeholders and trading partners. By providing a deeper understanding of the factors that should be considered when establishing a PFA, PFPP, PFPS or ALPP the guide aims to overcome the challenges and maximize the impact of these efforts to the benefit of all parties. The guide concludes by providing a number of case studies from around the world that highlight successful PFA and ALPP programmes and how they deal with particular key issues. This guide contains current experience and the most advanced phytosanitary procedures in the implementation of PFA and ALPP, however, it is subjected to revision and updates as new developments are made available.
