If my experience of the working of the Act only helps to bring all persons interested in Irish agriculture to the same opinion, and to show them that in order to remedy this defect some such amendment as the following is necessary viz., that all such disputes should go before a mixed jury of landlords and tenants, or a court of arbitra tion, even when only one of the parties is willing, I shall feel'that I have helped forward the cause of the tenant-farmer, and that the money I have spent in law has not been altogether thrown away. A statute of this sort, dealing with novel principles, reversing and modifying previous presumptions of the law, legalizing directly and indirectly many of the customs and usages of the country, and based throughout on the actual circumstances of society as developed in the dealings Of landlords and tenants in Ireland, cannot but be made more intelligible by a fair and candid statement of those customs, usages, and circumstances. Whatever my success, I can safely say I have spared neither pains nor conscientious endeavour to investigate and state the truth. A remedial statute must have much light thrown upon its meaning by an exposition of the mischief it is intended to meet. Without a proper understanding Of the causes and reasons of an Act, its language is often liable to doubt or misconstruction. This is especially true of the present statute. The Ulster custom, put in the forefront of the Act, and left without definition, necessitates some preliminary acquaintance with it, on the part Of those charged with the duty of administering the law which legalizes it. We shall find, probably, that our conclusions must take the form of suggestions rather than of positive enunciations of law, for the relations of the parties in the case before us are embrangled, and the dealings of the landlords of Ireland with their tenants have resulted, if I mistake not, in a very complicated stategof accounts. The facts besides of Irish tenure are varied, and not unfrequently asser tions regarding it made by one are contradicted by another; and on scarcely any point are the facts so distinct as to allow of a general statement being made without the introduction of large exceptions. I have therefore stated nothing of importance except on the evidence of witnesses speaking under responsibility, and I have constantly preferred, at the risk of being tedious to readers not deeply interested in the subject, to let those witnesses Speak in their own words, that my readers may be able for themselves to gauge their credibility. Book excerpt: Excerpt from Reports of Cases Decided by the Irish Land Commission When we found ourselves entrusted with the execution of a measure designed to confer great and immediate benefits upon the Irish tenant who should avail himself of them - the benefit, above all, of a secure tenure at a fair rent - and containing pro abling him to become the absolute and unfettered owner of his holding - when this great trust was committed to us, we resolved to do our utmost to render the procedure through which these great ends were to be attained one of extreme simplicity, as free as possible from all the snares and pitfalls of technicalities. Whoever has read the Rules and Forms which, in obedience to the Act, we have framed and promulgated, can judge in what degree we have succeeded in effecting this object. There are no pleadings, no elaborate enumeration of particulars, no statement of claim or of dispute. A tenant, for example, desiring to have a fair rent fixed for his holding, serves notice on his landlord, saying so, and stating the circumstances of his holding as to situation, present rent, and valuation - all of which lie easily within his own know ledges He has his choice as to the Court. He may either select the Civil Bill Court of the county or the Land Commis sion. And so soon as a copy of the notice is transmitted by post to the Clerk of the Peace or the Secretary of the Land Commission, the case is in Court, and will as early as possible receive a trial. Further, as we have sought to render the pro ceedings simple, so we have endeavoured to make them inexpen sive. The sole duties made chargeable are a shilling on each Originating Notice (that is, the notice which brings the ease into Court) and a shilling on each Notice of Appeal. We thought it right that these small duties should be imposed, if for nothing else, as a test of good faith, and they are such as no suitor com mencing proceedings in good faith would complain of. When the abolition or reform of any system of law is taken in hand, it is of the first import ance that the enactments of the existing code should be clearly understood; nothing is more dangerous than a partial repeal of legal prin ciples, which leaves other rules, which are either their logical antecedents or consequences, still subsisting; or an ill-considered reform which leaves mingled together in hopeless confusion enactments of different origin and contradictory nature.1870, and have proceeded upon the assumption that the law as it now exists is the same as that which subsisted prior to the former date; It is. Not to be expected that laymen should take upon themselves the irksome and uninteresting task Of' mastering the Acts of 1860 and 1870, and of eu quiring upon what principles the reforms in these statutes proceeded, and to What extent the previous law, for the better or for the worse, was thereby altered. The enthusiasm of more than one advo-l cate of a reform of the Irish law has been cooled by the discovery that the legal injustice, the sup posed existence of which had struck him as a cry ing wrong, formed no part of the law in question, and he has been hence induced to consider the complaints of the working of the present system as wholly unfounded. It may, therefore, be use ful to lay before the public, in a brief and popular form, the leading principles of the existing Irish Land Law; to show how it has grown to be what it is; how it differs from that existing in England upon what principles these changes have been made and to draw attention to the points in which the Irish Law, and the Roman and French Law upon this subject, resemble or contradict each other.
