If neighborhood schools are good, if property taxes and crime rates are low, then the value of the homeowner’s principal asset—his home—will rise. Thus, as William Fischel shows, homeowners become watchful citizens of local government, not merely to improve their quality of life, but also to counteract the risk to their largest asset, a risk that cannot be diversified. Meanwhile, their vigilance promotes a municipal governance that provides services more efficiently than do the state or national government. Fischel has coined the portmanteau word “homevoter” to crystallize the connection between homeownership and political involvement. The link neatly explains several vexing puzzles, such as why displacement of local taxation by state funds reduces school quality and why local governments are more likely to be efficient providers of environmental amenities. The Homevoter Hypothesis thereby makes a strong case for decentralization of the fiscal and regulatory functions of government.

Book excerpt: When a slumping housing market pushes a national economy towards recession, policy makers, investors and homeowners tend to focus their attention on federal regulation of housing finance. However, they have all but ignored the impacts of local and state regulations on the production of housing itself. This is surprising, since recent evidence suggests local and state land use regulations may play an important role in housing market efficiency (Mayer and Soerville, 2000; Glaser, Gyourko, and Saks, 2005). Furthermore, scholars have failed to reconcile opposing theories of land use regulations and housing supply, so consistent definitions of regulation and efficiency remain elusive. This dissertation will help reconcile the opposing theories of urban economics, political economy, and regional planning with the question: How do land use regulations effect housing markets? Do their impacts vary by scale? While these theoretical models yield radically different answers, most conclude that other regulatory approaches result in housing market inefficiencies. But with several perspectives and viewpoints, what are the fundamentals of various models? How well do models and theories portray real world markets? Which models should policy makers follow? This dissertation uses a three-paper approach to address these questions. The first paper, an integrative analysis, intimately examines the idea that land use regulations may have played a role in the emergence of the 2007 recession. Results financial deregulation and decentralization of land use in the 1980s set the stage for a large housing bubble and subsequent crash. Second, an empirical analysis examines local government regulation, competition, and housing construction in Southern California. Findings indicate that as cities permit more multifamily units, their neighbors permit less, suggesting that local regulations and intercity competition may inefficiently restrict certain housing types. The third paper analyzes the impacts of state regulation on housing growth in Maryland, and finds that it may increase multifamily housing in urban areas, but decrease in suburban and exurban areas. This suggests that cities in non-urban areas might view state regulatory incentives as a source of inefficient growth or public expenditures, and that "smart growth" programs have limited effectiveness.

The Economics of Zoning Laws is the first book to apply the modern economic theory of property rights to all major aspects of zoning. These constraints on land development within cities and suburbs aim to achieve various safety, environmental, and aesthetic goals. But the regulations have also tended to reduce the supply of housing, including multifamily and low-income housing. With reduced supply, many U.S. cities suffer from housing affordability problems.This study uses regression analysis to examine the link between housing prices and zoning and land-use controls. State and local governments across the country impose substantially different amounts of regulation on land development. The study uses a data set of court decisions on land use and zoning that captures the growth in regulation over time and the large variability between the states. The statistical results show that rising land-use regulation is associated with rising real average home prices in 44 states and that rising zoning regulation is associated with rising real average home prices in 36 states. In general, the states that have increased the amount of rules and restrictions on land use the most have higher housing prices.The federal government spent almost $200 billion to subsidize renting and buying homes in 2015. These subsidies treat a symptom of the underlying problem. But the results of this study indicate that state and local governments can tackle housing affordability problems directly by overhauling their development rules. For example, housing is much more expensive in the Northeast than in the Southeast, and that difference is partly explained by more regulation in the former region. Interestingly, the data show that relatively more federal housing aid flows to states with more restrictive zoning and land-use rules, perhaps because those states have higher housing costs. Federal aid thus creates a disincentive for the states to solve their own housing affordability problems by reducing regulation.

During the first half of the decade, housing prices increased at an unprecedented rate and homeownership rates reached an all time high. With an unrelenting demand for housing, many multifamily rental units were converted to condominiums and the overall stock of rental units decreased substantially. With the price of rental housing increasing and incomes remaining stagnant, many low- and moderate-income households found themselves struggling to maintain an adequate standard of living. This was magnified during the second half of the decade when the housing and financial credit markets crashed, leading to a parade of foreclosures and ultimately forcing millions of households into the rental housing market. During this same time period, government land-use regulations have increasingly become more restrictive. In theory, government-imposed land use regulations place constraints on how land can be utilized, which limits supply and increases costs. As a result, the cost of housing will increase, placing unnecessary burdens on low- and moderate-income households. Composed of three essays, this dissertation addresses various aspects of how increased regulation affects housing markets. In the first essay, I review the historical evolution of land use regulations with an emphasis on the regulatory environment in the state of Florida. An exhaustive review of the empirical literature describing the effects of land-use regulations on the housing market and the rental housing market is provided. While variations in magnitude exist, the majority of empirical studies find that increased land use regulations increase housing prices. The second essay of this dissertation focuses on the determinants of the rental housing market, attempting to examine how the percentage of income a household allocates to rent changes as a result of increased land use regulations. A description of the data used to access the regulatory environment is presented. The regulatory data is then quantified, using four unique econometric methods, and is used to estimate the relationship between the percentage of income that a household spends on rental housing and land use regulations. Results from the empirical models indicate that, consistent with theory, the rent-to-income ratio for renter households increases with more stringent land use regulations. The third essay investigates the relationship between land use regulations and high-risk loan originations. In order to motivate the empirical analysis, a review of the descriptive and empirical literature surrounding the determinants of subprime lending, the relationship between subprime loans and mortgage default, and housing supply elasticities is presented. After reviewing aggregate trends in income, home prices, loan installments, and foreclosure rates, I lay out the empirical model. The model is then estimated using regulatory and loan data from Jurisdictions in the state of Florida. The empirical model finds that increased regulations may lead to a higher percentage of high risk loan originations. The final chapter of this dissertation concludes and offers suggestions for future research.
