Book excerpt: Public land management and ownership came under increasing scrutiny in the 1980s, partly because of the increased value of federal lands; prized for their timber, minerals, energy, and amenity outputs. The personal touch and wisdom of one of these prolific and thoughtful writers on land use issues ensure that this book is a valuable addition to a literature to which Dr. Clawson already has made enormous contributions. For its readers, this book provides fresh insights and suggests new approaches to a problem that has been heavily discussed.

Book Planning By Law and Property Rights Reconsidered

Download or read book Planning By Law and Property Rights Reconsidered written by Barrie Needham and published by Routledge. This book was released on 2016-04-22 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: Countries which take spatial planning seriously should take planning law and property rights also seriously. There is an unavoidable logical relationship between planning, law, and property rights. However, planning by law and property rights is so familiar and taken for granted that we do not think about the theory behind it. As a result, we do not think abstractly about its strengths and weaknesses, about what can be achieved with it and what not, how it can be improved, how it could be complemented. Such reflections are essential to cope with current and future challenges to spatial planning. This book makes the (often implicit) theory behind planning by law and property rights explicit and relates it to those challenges. It starts by setting out what is understood by planning by law and property rights, and investigates - theoretically and by game simulation - the relationships between planning law and property rights. It then places planning law and property rights within their institutional setting at three different scales: when a country undergoes enormous social and political change, when there is fundamental political debate about the power of the state within a country, and when a country changes its legislation in response to European policy. Not only changing institutions, but also global environmental change, pose huge challenges for spatial planning. The book discusses how planning by law and property rights can respond to those challenges: by adaptive planning), by adaptable property rights, and by public policies at the appropriate geographical level. Planning by law and property rights can fix a local regime of property rights which turns out to be inappropriate but difficult to change. It questions whether such regimes can be changed and whether planning agencies can make such undesirable lock-ins less likely by reducing market uncertainty and, if so, by what means.

Book Land Use Regulations and Property Values

Download or read book Land Use Regulations and Property Values written by Rachelle Alterman and published by . This book was released on 2013 with total page 34 pages. Available in PDF, EPUB and Kindle. Book excerpt: The idea of reaping the 'windfalls' in land values due to planning decisions is by no means new. The underlying rationale is that much of the value of real property is created not by the landowner's work, but by government policies that grant development rights or by broad economic and social trends. Governments need the funds collected for financing public services of various kinds. This paper opens with the conceptual debate about value capture and its rationale, presenting the positions of proponents as well as critics. Drawing on the author's comparative research on the laws and practices in 13 advanced-economy countries around the world, the paper then addresses the degree to which recapture of the “unearned increment” from planning decisions is indeed a viable approach. Should policymakers adopt it for financing or incentivizing the delivery of public services and affordable housing? Only three countries among the 13 have adopted laws and policies about value capture at some point in their history. What lessons may be learned from their experiences? The findings show that the idea of value capture in its pure form has failed to catch on widely among advanced economies, with only a few exceptions. However, the basic idea of the “unearned increment” as a financial source for public services has not died away. In recent decades, several “mutations" of this idea have been gaining popularity in many countries, but in widely different forms and degrees. I call these "indirect modes" of value capture. These are much more complex and less “elegant” than the direct value-capture notion, and present legal and public-policy challenges. Yet in some contexts, these modes are more realistic instruments for funding public services. The paper concludes with a set of assumptions (for further research) about the legal-administrative conditions for the successful application of the indirect modes of value capture. These are still lacking even in some advanced-economy countries.
